    Default Can you gift an AR lower in PA?

    Simple question, with hopefully a simple answer.

    Can I gift a stripped lower to a friend privately in PA? My inclination was yes, but I just wanted to confirm with the people of PAFOA.

    My understanding is you can sell an Ar15 stripped lower face to face. like a long gun... I can't see why you can't Give one or "GIFT" one.. But don't take my word for it!! lol

    Yes.

    A bare AR lower is not a "firearm" to non-prohibited people in PA - it can be bought, sold, traded, gifted, etc between non-prohibited people just as if it were a coffee table.

    The ATF says the lower is a rifle, since that's the part that gets the serial number. Pennsylvania says a firearm is a handgun, or a short-barreled rifle or shotgun, but not a rifle.

    Ergo, ipso facto, et cetera, and other Latin words and phrases, you can gift/sell an AR lower to anyone else in Pennsylvania, just as long as they're not a Prohibited Person.

    The way I see it it is not a firearm and it is legal to gift it or sell it to any Pa resident.

    It would probably be illegal for the person you gave it to to make it into a pistol though.

    In PA, a stripped lower is not considered a firearm by definition because it has no barrel. It is also not considered a long gun.

    Federally though, the lower is by definition a firearm because it carries the serial number.

    No, the recipient could make a pistol from the stripped lower.
