    Default UPDATE****3/3 Constitutional Carry Convincingly Passes in West Virginia Senate

    The West Virginia Senate passed a sweeping firearms reform bill today by convincing 24-9 majority.

    Legislation to permit concealed carry of firearms without permits, background checks, or safety training (HB4145) passed the Senate Monday on a 24-9 vote.

    Opponents of the measure cited near-unanimous opposition from law enforcement agencies, with Sen. Bob Beach, D-Monongalia, commenting, “We’re setting into play a situation where we could have blood on our hands.”

    Proponents, however, said encouraging an armed citizenry will make the state safer. “

    One thing is certain: Where there are gun-free zones, there are more gun violence,” said Sen. Craig Blair, R-Berkeley.

    Likewise, Senate Judiciary Chairman Charles Trump, R-Morgan, cited a number of mass shootings, including weekend violence in Kalamazoo, Mich.

    “It’s hard to know whether or not an armed citizen would have been able to prevent some of that loss of life,” said Trump, who described the legislation as an expansion of the right to bear arms.

    The bill will go back to the House to reconcile minor differences between the House and Senate versions of the legislation before being sent to Gov. Earl Ray Tomblin.

    West Virginia Lawmakers Eliminate Concealed Handgun Carry Permit Requirements


    CHARLESTON, West Virginia — The West Virginia Legislature has approved legislation allowing residents 21 or older to carry a concealed gun without first obtaining a permit or undergoing training.

    The measure, passed on a bipartisan vote Wednesday, now goes to Gov. Earl Ray Tomblin for his review. He vetoed a similar bill last year.

    Most states require concealed carry permits.

    West Virginians between the ages of 18 and 21 could receive a provisional concealed carry permit and would be required to undergo training on proper use of guns.

    Passed on bipartisan votes by both the state Senate and the House of Delegates, the proposed law includes a $50 tax credit for residents trained to carry a deadly weapon.

    Senate Majority Leader Mitch Carmichael, R-Jackson, said credit would cost the state $3 million.

    The bill was opposed by the West Virginia Sheriffs Association and the West Virginia Association of Counties.

    Of course the bill was opposed by law enforcement. Of course it was. Here’s a prediction for you (and if we can remember it a year from now and find adequate data on this, we’ll assess my prediction). Nothing will happen. The doomsday predictions the LEOs most assuredly made will not obtain. There won’t be any discernible change in the number of firearms related crimes as a result of the elimination of permitting requirements.

    There should be more time this year. As I recall last year it was vetoed right at the end of the legislative session and there wasn't enough time to get everyone back in chambers to do an override.

    Sent to the governor 2/26. He has 5 days to veto, sign, or do nothing (letting it become law). Still plenty of time left for a veto override, and it only takes a simple majority.

    CHARLESTON, W.Va. (AP) - West Virginia is close to joining a short list of states that let people carry hidden guns without permits or training.

    The GOP-led House voted Friday to override Democratic Gov. Earl Ray Tomblin's veto of the bill. The Senate will likely follow.

    The bill would take effect in late May.

    Surrounded by law enforcement officials Thursday, Tomblin vetoed the bill over safety concerns. He vetoed similar legislation last year.

    It's legal in West Virginia to carry guns openly - in a holster, for instance - without permits.

    The bill would let people conceal guns in public without permits, by wearing a coat for example. People ages 18 through 20 would need permits and training with live firing.

    Alaska, Wyoming, Arizona, Vermont, Maine and Kansas similarly don't require concealed carry permits.

    Where in the constitution does it say you need a permit, backgroung check, and safety training to exercise your god given second amendment right?

    Where in the constitution does it say the pursuit of happiness does not include the "privilege" of driving a motor vehicle???
