The Senate is empowered to give advice and consent. But my Democratic colleagues want to change the rules. They want to reinterpret the Constitution to require a supermajority for confirmation. In effect, they would take away the power to nominate from the President and grant it to a minority of 41 Senators."

Most Democrats and Republicans in the legislature use the Constitution as a convenience to advance their political interests. When it comes to a replacing Supreme Court Justice the Constitution is clear. The President has the obligation to submit a nominee. The Senate has the obligation to inquire into the candidate, advise its position based upon that inquiry, and then straight up or down vote on the candidate with a simple majority only being required.

What the Republicans are saying now is exactly what the Democrats said in the final year of the Reagan Presidency when he nominated Justice Kennedy. The Republicans screamed the way the Democrats are now. It is all part of political gamesmanship. The republicans are bashing Obama for not staying within his Constitutional limits by virtue of his Executive Orders, and the Republicans are preparing to not meet their obligation under the Constitution to approve a Supreme Court Justice in a timely fashion. It's a swamp. The scum rises to the surface. "We the people" get to pay to clean it up.
