A 13-year-old Staten Island boy was accidentally shot by his father in their home with a gun the teen found and brought home with him, police said.

A Staten Island man was arrested after accidentally shooting his 13-year-old son when the boy returned home with a handgun he found, police said on Sunday.
The boy brought a silver Bryco 9-mm pistol back home to show his father after spotting it near their Covington Circle home along the heavily wooded W. Castor Place in Woodrow Friday night, authorities said.
When his father, Vitaley Velkin, 38, grabbed the gun it fired, hitting his son in the leg around 10:45 p.m., according to officials.
The teen was taken to Staten Island University Hospital North, where he was listed in stable condition.

Velkin was arrested and charged with assault, criminal possession of a weapon and reckless endangerment, police said.

So other then NOT shooting his son and keeping his finger off the trigger how is this the fathers fault and how is he criminally liable for something that was never his from the start? From the time JR brought the gun into the home and the father shot him could have been all of 40 sec. It seems to me that even without the accidental shooting that he would have been charged if he has just simply called the police to come take the weapon.

Staten Island is a shit hole, out of all 5 boroughs it has the worst crime which is unbelievable to people who grew up there in the 50's and 60's when most of it was still wooded and quiet. It seems the laws there are equality as repugnant as the people and the Island.

It's New York, everyone there is criminally liable the moment they see a gun, touch a gun, or even think about guns.

Gee, a Bryco pistol accidentally went off. Whoda thunk?

Let's see, 13-year-old finds a gun, brings it home, father attempts to take gun from son, son accidentally gets shot, and father is criminally charged with assault, criminal possession of a weapon and reckless endangerment. Gee, why not just tack on an illegal gun transfer between son and father and charge the son with criminal possession of a weapon.

New York City, gotta love it, maybe, maybe not.

Well, if kids are gonna be suspended from school for a make-believe shooting of a bow and arrow, it's only fair that a father handling a real firearm should get something....

My thoughts as well; perhaps the police don't believe the story, concocted to explain how the father had the gun in the first place.

It's pretty much the go-to lie for people caught with things they shouldn't have "I found it". Guns, drugs, severed heads, whatever. (see also "Rose law firm billing records and the 1st Lady's library table".)

Don't worry if you get caught holding dope in NY...just say your kid "found it".
