    BUFFALO, N.Y. -- For the second time this year, a gun rights group has won an open records lawsuit against New York State.

    SCOPE, or Shooters Committee On Political Education, most recently sued Governor Andrew Cuomo after his office failed to turn over documents related to a gun rights rally that took place in front of the state capitol in April 2014.

    The rally was attended by an estimated 3,000 people, including Buffalo developer and former gubernatorial candidate Carl Paladino as well as current presidential candidate Donald Trump. Those at the rally claim State Police confiscated replica guns and other materials in violation of the protesters' First Amendment rights.

    SCOPE contends Governor Cuomo and his staff orchestrated rules and regulations that were enforced by troopers in order to intimidate protesters and disrupt their demonstration.

    "I was there, and it was total intimidation," said New York State Assemblyman David DiPietro of East Aurora. "That was done by the governor on purpose to try and intimidate people."

    The governor's office did not comment when 2 On Your Side asked about those claims.

    SCOPE filed a Freedom of Information Law (FOIL) request to obtain the documents, but the state refused to turn them over, claiming attorney-client privilege. That's when SCOPE and its attorney, James Ostrowski, sued.

    A state supreme court judge in Albany ruled in favor of SCOPE and against the governor, who now has 30 days to turn over the documents or appeal.

    "This is a big victory," DiPietro said of the judge's decision.

    rest assured. the little whiner is already plotting at his revenge. he's a contemptible scumbag with a chip on his shoulder that he'll never be as popular as his father was (no...I have no idea why he was)

    I'll bet Govhomo is really afraid of the future outcome of this.

    The taxpayers get to foot more of his bills. But good for SCOPE for filing the suit.

    This has been pretty funny. We have a lot of dems around the country watching Obama and Clinton and thinking they are a big deal and can just do whatever they want, too. Not so fast, slimeball. You aint Clinton, you and Obama, and you aint the IRS. I hope you are shreading and smashing hard drives, because that shit aint going to flush for you like it does for them when the FBI shows up.

    I agree. It's time to clean house of dirty politicians. At a minimal he should be removed from office for abuse of power and the misallocation of government resources.

    Yes he will appeal, but will wait for Hillary to get in the white house and change a few supreme court justices when given the opportunity.
