    Everyone else has hit on the point of why you need to be careful in this situation and make sure you know what is going on.

    If I know what is going on, and know that one is truly a victim, I may intervene.....

    but consider this, you don't know what is going on, the guy on top kills the guy on the bottom, he is charged with murder.

    vs.

    The guy on top is about to kill the guy on the bottom, you intervene shooting the guy on top killing him, now you are charged with murder and all the stress, cost and possible jail time that comes along with it.

    worth the risk???? Something every carrier seriously needs to consider.

    The guy on top was probably a good kid, just got into college, who was walking to church. The guy on the ground must have dropped his phone/wallet/car keys, and the guy on top was trying to be a good citizen by forcibly returning them to him. Then he accidentally tripped and fell fists-first onto the other guy.

    The anti gun crowd has been around since the founding of the country so I do wonder out loud when a user which has no real posting history drops such a scenario in a new thread and then doesn't actively participate in the thread they started. Maybe they are asking a legitimate question they have and maybe not. Time will tell.

    It wouldn't really change the scenario legally. You still would have to evaluate whether the other person is in danger of death or serious injury. If it is a friend or relative I could actually see you facing tougher scrutiny from the cops if someone ended up dead.

    Wait .....the guy on top.....if he's a real bad ass looking MMA looking dude, wearing a Hi-Point t-shirt and carrying a chicken? If so the answer is yes.

    If on the other hand the dude on top is a skinny young black kid that was carrying a bag of skittles and smacking a chunky white looking dudes head into the pavement.....then the answer is still yes.

    Beyond that you're on your own.

    One thing I highly recommend. If you are going to carry a firearm; make sure you have a significant amount of personal liability insurance, at least, 1 Million Dollars.
