Selling Reloaded Ammo
A friend of mine that was a reloader and had a large cache of reloaded ammo on hand just died of lung cancer. His wife is selling all his guns and is trying to figure out what to do with the ammo. I bought all the .22s he had about 2000. I do not have a need or money to buy the reloads. She asked me if it was legal to sell the reloads. I am not sure and I am also not sure what the liability issue would be in doing this. I was wondering if the best way to do this would be to sell them as components. I thought see could then inform the buyer that they should reclaim the components. This guy was super careful and every box is labeled with the bullet type and weight, the powder used, the primer and even the speed of the load.
How would you suggest she proceed.

Re: Selling Reloaded Ammo
For sure it would be buyer and seller beware!
I reload A lot, But I only shoot my reloads in my guns.
I wont shoot mine in someone elses gun.
Legal wise I cant say.
I would think it might wind up being she just gets rid of them.
Hate to say that but, It is A sticky situation.

Re: Selling Reloaded Ammo
Far as I'm aware, it's not legal unless the maker was properly licensed, which is bs in itself.
See could in theory gift it I think...

Re: Selling Reloaded Ammo
Since she appears to be liquidating estate assets, as oppose to engaging in ammunition manufacturing as a business, no license is required.
Liability for untoward events due to defects in the ammo is a little stickier. I'll let the lawyers speak to the details but, from my perspective, provided she advises the seller as to the nature of the ammo (reloaded) and she disavows any liability at the time of sale (all in writing) - she establishes a defensible position.
Now whether the estate of the decedent can be held liable is a more interesting question that I would like to see discussed.IANAL

Re: Selling Reloaded Ammo
I've seen estates selling reloaded ammo under the proviso it has been handloaded ammo and buyer assumes all liability. Reloaded ammo is not a prohibited commodity or has restricted possession, so as long as you are not in the business of selling it for profit which requires a particular FFL license for it, it's really no one's business, especially not the government.
To me it's a waste to dispose of it, so even if one is leery of shooting it, the components can always be pulled down and reused.
I have no problem shooting someone else's reloads at all, as long as I know their ability. Friends and family shoot mine with no hesitation. Because what, like a bunch of fat communist babushkas on the production line at Barnaul, Russia give a crap about quality control for ammo going to the despised capitalist Americans? The only dangerous issues I have ever had with ammo is with Russian production. People seem to think because they bought it at Wal Mart or it comes in a pretty cardboard box that it's completely safe. Give me a careful reloaders reloads anytime over that.

Re: Selling Reloaded Ammo
She has not decided whether or not she is selling it because of the legal questions involved. I paid her $.07 around for the .22s. She has .45acp, 9mm, .380acp, 38 spl, .357, .223, .308, .243, 12 ga, 20ga, 28ga and probably a few more. At some point she will also be selling his guns and reloading equipment.
When she decides I will post in the classified.
