    Post Question about prohibiting offences

    I have a freind that was found guilty of perjury (F3) & false swearing - office proceedure (M2). would these two offences prohibit her from owning a pistol?

    Yes.

    If the penalty exceeds 1 year of jail are prohibited.



    Correction:

    2 years for state misdemeanors and 1 year for federal misdemeanors.


    Felonies are pretty much a prohibiting factor from the git-go on the federal level.

    She never served any time for it. She only had a year of probation. Would that info still apply to her?

    Yes. If she was convicted of a prohibiting offense she is prohibited. It doesn't matter how much time she served or not.

    I'm not a lawyer, but that's how I remember it from other threads on this same topic.

    Thats correct. Its not how much time she served(or lack of time), but what could have been a penalty.

    If she is willing and has the money she can go through the lengthy expungement/appeals process, but it's going to cost 3-5g MINIMUM.
