Question on gun transfer
My dad passed away almost 1 year ago and I was wondering if I had to get all the hadguns transfered to my name or not. If it was only a couple I would but, we are talking quite a few due to we have been collecting since I was 13 and now I am 35. Thaks Joe

Re: Question on gun transfer
Transfers between parents and children require no paperwork or FFL intervention. If the guns are in your possession, you're done. Enjoy them.

Re: Question on gun transfer
As gnbrotz mentioned, no transfer required for parent to child (in state).

There is a lot of great memories in the collection and I am working on makeing it bigger for my son some day. Thanx for the info.... Joe
P.S. I love this site. The amount of info everyone has is great and there are a bunch of just stand up guys and girls.. My hat is off to all of you.

Re: Question on gun transfer
Well, here's the thing: If your dad transferred them to you while he was alive, then that inter vivos transfer is legal and sufficient.
However, if you took them after he died, then they were part of his estate, and the estate personal representative is responsible for what happens to them, both for estate/inheritance tax purposes, and under the Uniform Firearms Act.
It's not clear to me that the exemption for transfers between a parent and child applies to a transfer from the parent's estate to the child, since the transferor is actually the estate administrator or executor, standing in the shoes of the parent.
Usually, nobody knows or cares about these details, but if you want to know the law, then details matter. And sometimes somebody remembers all those guns, is miffed about getting stiffed by the Will, and raises questions later.

Re: Question on gun transfer
Thanx , Gunlawer001 I do thank you for taking the time to give me a answer the legal aspects of this question. In my case my dad was smart becouse when I turned 21 a large portion of the collection is already in my name as he was buying them and I did all the paperwork(he new he would not live forever). As far as a estate is concerned I will not have to worry about other relatives trying to get them. Thanx very much Joe
