    Default Rivers Casino no carry.

I posted in another thread about the Rivers in Pittsburgh still having the gaming board firearm ban signs posted. They've since changed them.

The gaming board sign no longer mentions firearms, but they did put it on their own sign.

I don't know if you can read this or not.

The sign prohibiting firearms is not pursuant to the Gaming Board's regulation that is under repeal as the verbiage does not comport with the regulation. The sign appears to be the property owner/lessee [casino] banning firearms in their own right. I really don't expect any casino allowing weapons even after the formal repeal of the regulation.

058 Pa Code§ 465a.13 (d) A slot machine licensee shall post in a conspicuous location at each entrance to the licensed facility signs that may be easily read stating the following:

The possession of a deadly weapon, stun gun or other device designed to injure or incapacitate a person by any person within this licensed facility without the express written permission of the Pennsylvania Gaming Control Board is prohibited.

Yes, I thought I was clear about it not being on the gaming board sign. I apologize if I wasn't.

Wait, Since when did the gaming board get rid of the law saying you can't carry on casino property? Last I heard it was still under review.

But if the regulation is repealed, carrying concealed at a casino will be the same as carrying in a restaurant that prohibits firearms. Not a criminal action.

At least, that is my understanding.

“…the Board’s regulation at 58 Pa.Code § 465a.13(a) contravenes 18 Pa.C.S. § 6109(m.3)…Section 6109(m.3), on the other hand, prohibits a Commonwealth agency from regulating the possession of a firearm in any manner inconsistent with Title 18. The Board is a Commonwealth agency….Accordingly, the Board’s regulation is inconsistent with the provisions of Title 18 inasmuch it regulates the possession of firearms in a location (licensed casino facility) not contemplated by Title 18.”

Cool thanks for the link, Rep inbound. So unless Parks or Harrah's [Chester] have visable signs at each entrance I'll be carrying from now on.

The casino in Erie still has the original signs that have been there for seven years, saying that it was a criminal offense to bring any weapon onto the premises. I asked about it, and one of the managers said he hadn't been notified of any change.

You are basically correct EXCEPT entering a business contrary to conditions of entry is subject to criminal action (Criminal Trespass (18 Pa CS 3503)) - the 'notification' element of the trespass crime being satisfied by the signage.

FWIW the regulation under discussion has no direct application the PATRONS but only imposed an affirmative duty on the casino licensee to post the 'No Firearms' signage. The force of law, when applying it to patrons, was always through the trespass statue. As such, the repealof the regulation only removes the duty of the casino to post and would not prohibit them from posting in their own right as property owner/lessee.
