Default Shaneen Allen to be admitted into pretrial intervention

    .

good news......charges will be dropped after she completes the program

The Philadelphia mother facing prison time for bringing her legally registered gun into New Jersey will be allowed into a diversion program, Atlantic County Prosecutor Jim McClain has announced.

McClain originally denied Shaneen Allen pretrial intervention because he said the state's Graves Act did not allow for the exception.

But, today, the attorney general released a clarification on the 2008 directive that expanded the law's reach.

In most of these cases, imprisonment is neither necessary nor appropriate to serve the interests of justice and protect public safety," acting Attorney General John Hoffman wrote in the clarification issued to the state's county prosecutors today.

"In applying the factors set out in the clarification, I determined that the defendant in this case should be offered the opportunity to be admitted into the Atlantic County PTI Program," McClain said.

"I have communicated that determination to the court and defense counsel."

McClain previously said he did not allow such exceptions because they were so common that, if it had been the Legislature's intent, that would have been among the written exceptions.

The clarification also means McClain will now review other similar cases that have been denied PTI in the past.

Now get the stupid law repealed so it doesn't hurt someone else.

The only reason the Dirt bag AG lowered the charges is because of the public outcry over this issue. It's been tagged all over social media for months and has come up several times by reporters and citizens in interviews with the Gov who said multiple times he will not get involved until the final judgement has been made due to giving the AC DA the proper time to study the case and make the right call. He also stated that good people make common mistakes like she did and they do not deserve to be prosecuted like the criminals the laws were meant to be for.

There is also a Republican in the Senate who wants this law changed or removed. He stated he was going to wait pending the outcome I am hoping that it's still put in no matter what.

I read this is the same AG that let Ray Rice of the Baltimore Ravens walk after he knocked out his fiancee in an elevator in Atlantic City.

Yet he was originally going to press full charges against this single mother of two.

Quite the twisted gent, isn't he!

    God bless!!

Yeap. This is why blanket condemnations of "New Jersey" are not fair. These folks went to bat for this lady, who wasn't from New Jersey, to make a point about the unfairness of New Jersey "law".

I am disgusted as the next person here by New Jersey politicians. I think Frank Lautenberg was a piece of crap. His "Domestic Violence" law was a cheap shot at all gun owners. Robert Hughes, one of the authors of the Hughes-Rangel machinegun registry freeze, is another awful person.

There are good people in New Jersey who need our help, support and encouragement.
