    Default PICS Denied - Witness to crime on record?

    I was recently turned down for a PICS check and have since submitted a challenge. I am an Army veteran and have access to all of my records through a friend of mine who is a parole officer.

    Under my criminal docket search, the only file that comes up for me is an active DUI case listed for another party. I was a witness to this DUI and testified in court about a month ago. I find it strange that this is now on my record, but that is all that is there

    Could this be causing my PICS check to fail?

    There may be someone with your same name in Pa with a new PFA file, or a fresh DUI case that research needs to clarify.
    this happens all too often.

    I really doubt that would cause you to get a denial. I'm in the system as a witness/RP for many things over the years, including a DUI wreck where a girl was hit head on by a drunken idiot.

    Being a witness does not deny you through PICS.

    And your "friend" is putting himself in deep crap by doing you a favor and looking up your record.

    Unless he is using the public database but then witnesses wouldn't show.

    What type of discharge do you have? Any visits to mental health in your military health record? Maybe that stuff reported negative on you?

    I apparently have a 302 from age 16 where I was held 72 hours that states:

    "...patient was sent in because he plays video games for 10 hours a day and doesn't listen to his mother..."
    "...non violent, denies thoughts of suicide..."
    "...patient has no need for emergency psychiatric care."


    I'm an Army veteran that used to fire 120mm sabot rounds out of an M1A2 and I can't legally own a gun in PA.

    Get a lawyer. You may be able to attack the validity of the 302. I think that is the only route you have until the legislature fixes the no-restoration problem for 302s.

    Your friend could get both of you in trouble for that one. I wrote a computer program for a court system that did nothing but track JNET access as to why a record was being accessed, who the information was decimated to and so on. The whole point of the program is for when they get audited.

    I wasn't even allowed to run my own name without a reason to run it.
