DISARMED during Philadelphia open carry stop. 4-1-14
NOT AN APRIL FOOLS JOKE
Hey everyone. First post with my new user name. I' m formerly the artist known as EMT-B_Medic_Student.
So I went out in my neighborhood of Manayunk for some breakfast at Bob's Diner. I was open carrying my Glock 23 in my Viridian TACLOC Lev II retention holster. I ate my breakfast without incident, except burning my tongue on the hot, fresh blueberries in my pancakes. I'm not sure in anyone noticed I was carrying, but no one made any remarks or asked any questions. I've carried here once before and one of the staff members said" You're really making waves with that gun, a few people have noticed it."
While I was eating my breakfast, I noticed a female officer across the diner. I doubt she noticed my firearm when I entered. So as I get up to pay my bill, she does the same. Now i'm standing in front of her and she can clearly see my firearm. She doesn't say anything and I leave the diner. As I'm walking to my car, a PPD officer drives by. I'm not sure if the female officer signaled him, or he noticed my firearm. He makes a quick u-turn. As I'm getting into my vehicle the following encounter occurs.
PPD Male Officer-( Stopped in the middle of the street with his window rolled down)
Hey, you on the job?
ME- Nope.
PPD Male Officer- Okay well don't get in your car yet, hang on a sec.
Me- Okay.( I put my leftovers from breakfast in the car.)
As the officer is walking up to me, I turn on the Voice memos app on my Iphone.
PPD Male Officer- No need to record this, no one is going to harass you.
Me- It's for my protection.
PPD Male Officer- Okay turn around and put your hands on the roof off your car.
I just get the recording going and place the phone on the roof of my car.
He reaches for my firearm and attempts to take it out of the holster.
Me- Can I ask why I'm being disarmed?
PPD Male Officer- You're being detained for investigation only because you're carrying it out in the open. Just let me see some ID with your carrying permit.
He removes the firearm without shooting me in the leg.
I inform him that i'm going to reach in my pocket and get my wallet.
He removes the magazine, racks the slide and removes the round in the chamber and places the mag and firearm on my roof.
PPD Male Officer- Can I also get your drivers license.
He calls it in over the radio to check if i have a valid license to carry
He seems to be using a lower tone of voice to avoid the voice recorder.
PPD Male Officer- have you ever been stopped for this before?
Me- Yes
PPD Male Officer-Where are you coming out of?
I thought he meant where do i live and i say here in Manayunk.
PPD Male Officer- No where were you coming out of.
PPD Female Officer- Out of the diner, when he walked out, thats when I saw him.
PPD Male Officer- Listen man that can be alarming.....You're not being harassed.... i've had some people do it in a laundromat. Where there are kids and families. That can be alarming to them. And also to the police. Thats why I asked,I didn't know if you were a plain clothes officer. But when you said you wasn't i mean....
At this point the dispatcher says over the radio" 15.. Answer your cell phone.
He goes to the patrol car and answers his cellphone. I can't overhear if the call is about me.. but I'm assuming it is since I've had a few encounters with the PPD and have filed a complaint with internal affairs.
The female officer removes my firearm from the roof because there are schoolkids exiting the church. She temporarily holds it and when the scared, frightened, alarmed children are gone, she places it back on the roof.
Female PPD Officer-Especially now a days. People are crazy, you just never know.
Me- Thats why i carry.
Female PPD officer- I understand that, but what about the element of surprise?
Me- I don't believe in that" Element of surprise" If something is going to happen, its going to happen.
Female PPD officer- But if someone is out to get you, they're already gonna know what you have.
Me- Believe it or not, most people don't even notice it. I understand both sides of it, but I prefer to open carry so that i can have quicker access to it. Sometimes I conceal and sometimes i open carry.
Female PPD officer- But that's why you practice.( referring to drawing from concealment"
Me- I do practice. That's why I prefer open carry
Male PPD officer- This is the worst way to draw our attention.
Me- I'm not trying to draw anyone's attention.
Male PPD Officer- Well this is the worst way to draw our attention.
More questions between dispatch and the Male officer
I hear dispatch say" Valid through 9-19-16"
He hands me my firearm and i holster it.
Male PPD Officer- Hold your hands out
I do
Male PPD Officer- No both hands like this, like your gonna get some candy.
He then proceeds to empty my magazine into my hand and places the mag on top of the loose rounds.
Me- Is this really necessary?
Male PPD Officer- Yes you can load up in the car.
Me- okay have a good day.
Both officer- You too.
7 and a half minutes of my day wasted by the PPD.Prior username:EMT-B_Medic Student.

I could HARDLY tell you were enjoying the encounter with all the consenting and high fiving going on as you stood there like a child with your hands out getting your stolen property back
So have you decided yet? Are you sending a fruit basket or flowers along with your thank you card?

Did I miss the part where OP asked if he was being detained, and on what RAS? I say he sends chocolates to the Female PPD and a fruit basket to the other JBT.

Okay, I have to ask, why would he get his ass reamed? Serious question, I'm just new to this world. I understand there are different views on the open carry vs conceal carry. I think he has a right to open carry if he wishes. Emptying the magazine was just plane mean and unnecessary.

Sorry OP, you really should have protested more. For what it's worth, your new screen name fits well. You truly do know harm, as they harmed your rights and you know it!
