    Default OC situation question

    A guy is sitting in the bus station with a loaded 357 revolver in a holster in plain view(OCing). Two police officers approach after receiving the man with a gun hysterical 911 call. They ask to see his LTCF. He says he has one, but refuses to show it because he is not concealing. They arrest him. Who is right here? Do you need an LTCF to OC?

    A LTCF is also needed during a Declared State of Emergency - which, I do believe we are still under one.


    But sans Philly and an emergency - no license is needed to OC on foot.

    I duuno, can they go on the assumption that he intends to board a bus which would then require the LTCF?

    I would think "no", but you never know.

    Not Philly... not a state of emergency... no LTCF needed to OC... then police were wrong to arrest him, right? OR, can they arrest him for refusing to show his LTCF when asked?

    They have no grounds to arrest a person OC'ing for refusing to show their LTCF.

    With no city of the first class or no emergency, the only other possible situation is if they witness him in a vehicle at some point in time. They would have to witness that act though.

    Otherwise, no LTCF is needed and the arrest would be unlawful.

    I always wonder when these "state of emergency" comments are brought up - just how many people in law enforcement have ANY knowledge of that stipulation - at ALL.
