    Default License needed to sell ammunition?

    Can someone tell me 100% whether or not any license is needed to sell factory loaded ammunition from my home? On the Pa. state website, it seemed that I would be required to collect tax and file a return on any sales I made. Is this correct? I know just to sell antiques at a flea market I had to get a sales tax license and file quarterly returns. Someone please square me away, thank you!

    Here it is straight from the horses mouth:

    Q: Is a license required to engage in the business of selling small arms ammunition?

    No. A license is not required for a dealer in ammunition only, but a manufacturer or an importer of ammunition must be licensed.

    [18 U.S.C. 922 (a)(1)(B)]

    However, as you said, you will have to have a PA Sales Tax license and claim any profits on your tax returns.

    If your are buying ammo for resale, you are running a business. As such, you must comply with local ordinances and must collect sales tax because it's a business. Same as going to a flea market every Sunday or holding a weekly yard sale.

    Do a good check on local ordinances. Besides collecting state sales tax, you might need a Business Privilege License or have to pay to other fees to operate a business. If you are selling it out of your home, watch the zoning.

    It all depends on your county / municipality. Cross all the t’s, dot all the I’s.
