    Default Self defense shooting

    This happened not far from me. After all my time here it still amazes me the amount of misinformation out there.

    A Plains Township man is jailed on a criminal homicide charge following a shooting in Forty Fort that began as a fight over a snow blower, police said.

    Brian Pavia, 39, is accused of fatally shooting John Dulsky after he claims Dulsky punched him, according to police.

    Police say Pavia called 911 about 6:50 p.m. Tuesday and summoned officers to 1217 Wyoming Ave., saying he had been attacked and had shot someone.

    Officers arrived to find Pavia standing next to a Ford pickup in the driveway.

    What misinformation? I did not sense a lot of editorializing in the article.

    My opinion from what little info there is;
    1. I have no idea at all if the shooter had a legit fear of bodily injury to the point of justifying a shooting.
    2. The bullet in the dead man's back will likely give the shooter's defense attorney a hard time.

    Look at the comments..

    People have heard this or that and just accept it as law.

    This is far from shooting someone breaking into your house armed in the middle of the night.

    SYG may help in his defense, because there is no duty to escape, but what about the escalation of the argument? The shooter may be seen as the aggressor.

    Who owned the building? Who owned the snow blower? If the shooter entered the victims building without permission and was taking/stealing his snow blower the shooter will not be in a really defensible position.

    Who owned the snow blower is not clear. Other articles say that the shooter had gone to the house to pick it up and Dulsky happened to e visiting.

    Normanvin we need more facts, relying on what we have from news outlets does not help. They say these two had runnins before.

    I have also heard a rumor. Mind you a rumor that the dead guy might have been in trouble with the law in the past.

    I agree facts are short. But they alwYs are with the media.
