    Question options AFTER DUI/with ARD

    Hi All, time to pick your brains. I know of someone (no not me) that has received a DUI and agreed to probation with A.R.D. program. What are the options for self defense that are available to them?

    The person needs to check with the probation officer to see if he/she is prohibited from firearms as a condition of the ARD and probation. Sometimes they are, sometimes not.

    Make sure once the ARD program is fulfilled, thier lawyer files a motion for dismissal of charges and expungement of record. Otherwise it will follow him/her for the rest of their lives.

    While on probation you're screwed. More than likely your PO will not allow any firearms, nor any non-kitchen knife to be in your possession.

    After one year ARD will have the records expunged, most likely there was no conviction, just a plea of no contest.

    If you're ineligible to possess a firearm, you're also ineligible to possess a stun gun, Taser, or electronic incapacitation device.

    I would not trust anything like this to happen automatically. Someone has to do it and what if the people administrating the ARD forget?

    After ARD, the person should havehis lawyer follow up and make sure it's taken care of.

    The records aren't always automatically expunged, it varies county by county.

    In my niece's case, her attorney applied for expungement as soon as her probation was completed. The DA was given 30 days to object, and a couple of days later told the court that he had no objection. The judge granted the expungement a few days later, and I think the "keepers" of the various databases had 30 days to clear her record. BTW, during her probation she was forbidden from living in any place where any weapons were present, regardless of "possession" or "access." It varies by county, so check up on it to be sure.
