    Default Misdemeanor void permit?

I have a retail theft misdemeanor 1. Paid a $160 fine. Thats it. Is it going to hold me back from obtaining a concealed permit? I bought a pistol and would like a permit. This misdem. was back in 2004.

A retail theft M1 conviction (18 Pa CS 3929) is a PROHIBITING offense. You cannot possess a firearm or ammo anywhere in the US including territories under Federal law (18 USC 922(g)(1)).

Of course this also eliminates you from LTCF consideration.

How did you legally buy a pistol? Were the charges reduced or ARDed?

Was M1 the charge or the conviction? The difference could be enormous.

I'm just thinking that a fine of 4160 doesn't seem to be consistent with a conviction as serious as an M1.

Additionally, it just may be that enough time has passed that you could begin looking into having the conviction pardoned by the governor and then try to have it expunged. If successful you could then purchase, possess, and apply for a license to carry. I would suggest an attorney with a successful history of obtaining pardons/expungments.

My father inlaw owns a gun store. I stood there during insta check. Approval number on paper.

He told me the offense had to be violent to be declined. So on the concealed paperwork, it asks about being convicted of a crime under 6105(b), do I check? I believe it was a first offence misdomeanor. I was young and thought I had a fine, and didnt realize what it intaled.

Also, retail theft 3929 as you stated is Not on the list section 6105(b).

LOL... what is this, shorthand? You know you don't have to pay by the word, right?

I can't tell from these 2 posts what happened.

And no, it does not "have to be violent". It would be the M1 that would make it prohibiting, IF that was the conviction.
Can you look up your record and see *exactly* what it was? Memories can be tricky, especially when you're not sure
    what you're looking at anyway.

What I remember, It was a first misdomeanor for retail theft and got a fine. I did get finger printed too. Thats it. It was on speakerphone when the check was called. Apparently I CAN own a gun and ammo.

I dont have any papers on the whole thing. I was young and dumb before I went to the military. So memory is what I have. I was declined a job position because of it. Thats why I am curious to know if its a waste to try.

I wonder if he got ARD?

You see, you may have been charged with a M1, but convicted of an M3, M2, whatever. The arrest and charge are irrelevant, only the conviction matters.

I was 18. I searched my name, dob, county, and court this time. Still no records found on that site.
