    If I lived there I wouldn't comply with shit. In fact, if PA tries anything, I'm not complying with that either. If the government wants to ban guns, fine...but I'm not banning my guns. The government doesn't have to shoot them if they don't want to, they can use their own. If I have the power to vote for a politician, then I also retain the power to not listen to 'em. They keep pushing and pushing, now see where its going to get them...a revolution, and a bunch of dead tax payers...mark my words...

    I have no desire to defend any portion of NY gun law, but this is a fairly common misunderstanding that should at least be corrected.

    For purposes of that section of law, a "firearm" is a "pistol." In NY, you cannot possess a pistol without a permit. Possessing five or more pistols without a permit is considered a more serious offense than possessing fewer than 5 pistols without a permit, hence the escalation in severity of charges.

    Exemptions are provided via licensing.

    I assure you that a licensed person may legally possess many more than five firearms in NYS.

    Do not mistake this post as being in support of requiring a license to possess a handgun, or any other NYS gun law.

    Do people not read before posting misleading titles?

    A person is guilty of criminal possession of a weapon in the second
    degree when:
    (1) with intent to use the same unlawfully against another, such
    person:
    (a) possesses a machine-gun; or
    (b) possesses a loaded firearm; or
    (c) possesses a disguised gun; or
    (2) such person possesses five or more firearms; or
    (3) such person possesses any loaded firearm.
    Such possession shall not, except as provided in subdivision one or seven of section 265.02 of this article, constitute a violation of this subdivision if such possession takes place in such person's home or place of business.
    Criminal possession of a weapon in the second degree is a class C felony.

    What's you're take on the second section (265.04)? That proposed law doesn't have the last line that details the exemption for "home or place of business". Is that how everyone else read it? So would it be illegal (if passed) in NY to have 10 or more guns?

    That I'm not sure about. We have to find the whole text of the bill and not small snippets that someone else hand picked. Perhaps there is an exception for that too that the author of the article left out? Regardless, it is NOT illegal to own 5 firearms in NY, as the thread title would suggest.

    EXACTLY !!! I know we are saddled with Philly, but our Commonwealth is pretty decent compared to the rest of the A Hole Blue states in the NE.
