I THINK a father can pass down a pistol to a son with no paperwork as long as same last name. Do not know about mother. I do not know for sure or the specifics behind it. This is just what I've heard, I've never researched it or asked a professional. I do not have a legal background so keep researching.
There have been threads on the parent/child transfers here before, please, before you reply, do a search first, it may well prevent you from posting an incorrect answer, such as you have just done.
    Government 99 and 44/100 % pure bullshit.

    OK.
For the record, it is a pistol not a shotgun or rifle.
As far as I read, it is legal.
    Makes sense to me.

For arguments sake, say my mother went to sell the gun. It would still be in my name. Doesn't that complicate things.

That scenario isn't going to happen. Just wondering what you guys think.

It is not really in anyones name. There is a sales database that may be used illegaly (by LE) at somepoint. It does not complicate any future legal transfers.

You seem to have some of the more common misconseptions. I would suggest you check out some ot the stickies at the top of most subforums. There is also a referance library that the gun laws of our state.

Mothers must also walk three paces behind fathers on public streets. This is just what I've heard, I've never researched it or asked a professional.

To put the end on this thread:

PA law allows the transfer of a gun (rifle, shotgun, pistol, revolver) between a parent and child, child and parent, grandparent and grandchild, grandchild and grandparent and between spouses, as long as the recipient is not prohibited from owning one, and they both live in PA, WITHOUT ANY TYPE OF TRANSFER PAPERWORK REQUIRED.

However, that said, because of the abuse of the sales database, by some LE personnel, many of the above transferors and transferees opt to have the "gift" (if a handgun) transfered at A FFL so that the name of the person getting the handgun is in the sales database. That way, if the handgun is "run" by a LEO (illegally), for whatever reason, the handgun shows the new owners name which then makes it less likely to be confiscated by the LEO and requiring the legal owner to prove it is theirs to get it back.

You may want to do 2 things:

    1. Transfer soon, before Federal law may change (ATF) due to the quest for Universal Background checks by the Gun Control advocates. It is anyone's guess how this will play out. If passed there may no exemtion for in the immediate family transfers that exist now.

    2. You may want to use a "Bill of Sale", found on this site and have it notorized to document date of transfer. Not necessary, but if #1 above comes about, you will be covered. Just a thought.

Or just do the transfer at a FFL.

My mom has a .38 that she owned for almost 30 years. It's a Rossi, she no longer wants it and is giving it to me for Christmas. I have a ccw permit, I would Loire to carry it. Is there anything I need to do to take ownership and to carry it?
