Re: AG Kane closes "Florida Loophole"
2. If you are a dual resident of Pennsylvania and Florida you need not
apply for a CCP in Pennsylvania if you currently hold a CCP from
Florida. You must, however, carry with you proof of your Florida
citizenry/residence along with your CCP identification when you are
carrying a concealed firearm either on your person or in a vehicle.
If this is the case, it simply means that you'll be forced to open carry outside of your vehicle if you rely on a florida license, and you won't be able to take your gun with you outside your car in Philadelphia (IANAL). The AG does not have the power to countermand statute.Last edited by General Geoff; February 8th, 2013 at 02:12 PM.

While many claim to support the right, precious few support the practice.

Re: AG Kane closes "Florida Loophole"
Just looked up the statute.
18 Pa.C.S. § 6106
(a) Offense defined.--
(1) Except as provided in paragraph (2), any person who carries a firearm in any vehicle or any person who carries a firearm concealed on or about his person, except in his place of abode or fixed place of business, without a valid and lawfully issued license under this chapter commits a felony of the third degree.
(2) A person who is otherwise eligible to possess a [FN1] valid license under this chapter but carries a firearm in any vehicle or any person who carries a firearm concealed on or about his person, except in his place of abode or fixed place of business, without a valid and lawfully issued license and has not committed any other criminal violation commits a misdemeanor of the first degree.
(b) Exceptions.
...
(11) Any person while carrying a firearm in any vehicle, which person possesses a valid and lawfully issued license for that firearm which has been issued under the laws of the United States or any other state.
This also brings about its own interesting potential loophole, you might still theoretically be able to carry in Philadelphia under a nonresident FL license, as long as you're on a bicycle and not on foot.Last edited by General Geoff; February 8th, 2013 at 02:52 PM.
