    Default Hypothetical scenario out of state travel New Jersey

    If you work in PA and have your LTCF but have to travel to Jersey for business is it legal to unload and lock up your firearm in the vehicle ? I assume keeping the ammo separate from the firearm. Similar to interstate transporting in non reciprocity states?

    Problem is what if you have to stop and stay in Jersey for a few hours ?

    And what about hollow points ? Do they still have that law on the books ?

    Might happen in the next few weeks so I want to be prepared ?

    IANAL, but I'm pretty sure it's a NO!

    Your state of origin (PA) allows it, and your destination state (NJ) does not. But if you had to travel through NJ to say Delaware if you had a reciprocal permit, yes FOPA would cover you as long as you made no unnecessary stops (like grabbing a burger).

    As to HPs - under the scenario you pose their possession is illegal.

    I work in New Jersey. I don't even carry an assisted opening knife into the garden state. New Jersey is a nanny state. The nanny doesn't like guns.

    Just to be clear on this, I don't think federal interstate carry laws address ammunition at all so even if you were to pass through NJ (non-stop) and otherwise be compliant with federal interstate carry, you would still be in violation of NJs HP law.

    You are correct that arguably ammunition and accessories (ex:mags) do not fall under FOPA transport protection. I addressed this issue in my.


    Since the OP was terminating his trip in NJ he then fell liable to NJ's HP law which does not ban HP possession but restricts it to very specific exemptions - none of which apply to the OP's scenario.

    What about an expandable baton ? Just don't like going in with only a flashlight ....

    Maybe/maybe not. Depends on interpretation of:

    2C:39-3. Prohibited weapons and devices

    e.Certain weapons. Any person who knowingly has in his possession any gravity knife, switchblade knife, dagger, dirk, stiletto, billy, blackjack, metal knuckle, sandclub, slingshot, cestus or similar leather band studded with metal filings or razor blades imbedded in wood, ballistic knife, without any explainable lawful purpose, is guilty of a crime of the fourth degree.
