    Default Gun Trade with Brother?

    My brother has a glock 19 and I have a glock 26 - we're both carry permit holders and neither have had so much as a serious traffic ticket.

    Can we legally trade guns without an FFL?

    You could legally loan the guns to each other (see §6115(b)(i)), but to do a true transfer of ownership you need to use a FFL. Siblings do not have an exemption. Only spouses, parents to children or grandparents to grandchildren are exempt from this requirement (see §6111(c)).

    Or you could marry him as spouses are also exempt.

    Guys,

    Though not specified in the law, can't one effectively gift to parents / grandparents who then gift to each of the other brother? Assuming we can all follow that sentence structure/logic that is!

    I know one could argue it goes against the spirit of what is written but one could also argue that is why siblings are not mentioned. Then again, if the parents and grandparents have departed...

    IANAL but wonder if this a loophole?

    I agree that this is certainly an option, but if questioned in court, timeframe could prevent a problem. I can envision more of a problem if the parent had possession of the firearm for one year (or even one month) than if they had possession of it for sixty seconds.

    Of course the time line would only be known upon self admission.

    Very true. I can't imagine the circumstance where it would even end up in court being scrutinized, but if it did, surely a decent attorney would make an issue of the timing if it seemed to be in their favor to do so. The choices would then be to answer truthfully or 'plead the fifth'.
