Former magistrate gets a slap on the wrist
I read this in my local paper that former magistrate Donald Presutti was sentenced to 90 days probation, anger management classes and 120 days community service for carrying a weapon concealed without a permit, he was alleged to have had an argument with his father-in-law and had returned to the place of argument with the gun in his jacket. This is a felony and this guy should do time, why have ridiculous penalties if they are not enforced?

Perhaps you missed the memo, silly peasant? They're our superiors, better than us in every way, and the laws for us commoners do not apply to them. Get back to the fields and stop rocking the boat.

Here is the Judge who sentenced him maybe everyone should give him a call tomorrow

I'm going to call and politely ask for a sentencing explanation because not only was it knocked down from a felony but he should get time and lose his law license.

Such a totally ridiculous and flagrant double standard. Professional courtesy by one of his peers? Maybe. On a related note, could we please go back to a system of punishment that includes fines and jail as opposed to half assed feel good punishments like anger management classes and probation?

Assuming he would otherwise be eligible to successfully obtain an LTCF, would he not then be charged as a 1st Degree Misdemeanor? I think that is what is allowed by statute. Maybe I misread, but was he a prohibited person?
