    Default state of emergency?

I looked around this site for about 15 minutes and cannot see where the rules for OC/CC change during a state of emergency (SOE)? Given we are gonna get wacked by Sandy (at least here in the eastern part), can anyone post a link or a clarification of how the rules for firearms change during a declared SOE? Thanks

I thought it was just you need a valid LTCF to open carry.

    18 Pa.C.S. § 6107: Prohibited conduct during emergency

    (a) General rule.--No person shall carry a firearm upon the public streets or upon any public property during an emergency proclaimed by a State or municipal governmental executive unless that person is:

    (b) Seizure, taking and confiscation.--Except as otherwise provided under subsection (a) and notwithstanding the provisions of 35 Pa.C.S. Ch. 73 (relating to Commonwealth services) or any other provision of law to the contrary, no firearm, accessory or ammunition may be seized, taken or confiscated during an emergency unless the seizure, taking or confiscation would be authorized absent the emergency.

    (c) Definitions.--As used in this section, the following words and phrases shall have the meanings given to them in this subsection:
"Accessory." Any scope, sight, bipod, sling, light, magazine, clip or other related item that is attached to or necessary for the operation of a firearm.
"Firearm." The term includes any weapon that is designed to or may readily be converted to expel any projectile by the action of an explosive or the frame or receiver of any weapon.

    Simply put:

If you have a LTCF, nothing changes for you.

If you don't have a LTCF, you cannot carry ANY firearm, openly or concealed, on public property.
    Everyone should have an AK-47

And the State of Emergency ends when the governor explicitly says so. Usually it takes a couple of months for this to happen.

Or carry any long gun on public streets or property. The additional limits apply to ALL types of firearms, not just the usual "handguns, SBRs, and SBSs" that fall under licensing per the definition contained in 6106.

Does any one know if the SOE changes anything pertaining to the OC/ CC of Long guns?

Also, what about transportation of long guns?

Yes. You may not carry/transport them on public streets or property unless you are licensed, or otherwise exempt per 6106.

Thank you for the info, however I was not clear in my post.....

My real question pertains to the deliberate transportation of long arms without the intent to go to a shooting range or a gunsmith ect... assuming you have your LTCF, are there any specific changes allowing you to transport the long arms for defense type reasons! Or the ability to OC at your destination?

I don't plan to do so, but am curious as to wether or not the rules change at all on that during a SOE.
