    Default Lawyers or help in Harrisburg area.

    I am just now finding out by talking to the state police that if my second DUI was a Misdemeanor 1 I am Federally ineligible to own any firearm. I would like to know for sure if I can or can not and if I can get that changed somehow and good lawyers in the Harrisburg are that may be able to answer my questions and find out for sure. I wonder what this will cost me to find out these answers. I cant remember if it was an M1 conviction or not it was seven years ago

    You can look up your case here: http://ujsportal.pacourts.us/DocketSheets/CP.aspx

    Use the drop down menu and select "Participant Name". Enter your last name, first name, and the county the preceding took place in.

    If it's in there you will get a hit. Mouse-over the emblem to the left of the hit and select "Docket Sheet".

    In there you should see the charge(s) and disposition. Under Final Disposition is what you need to know.

    If it was a M1, well - then you will need to keep your distance from guns and ammunition because a PA M1 has a max possible sentence of 5 years.


    The only way to undo such a prohibiting conviction is by a governor's pardon, which then will need an expungement after that.

    A second DUI conviction, if highest rate, results in an M1. Frequently, the Courts do not specify the degree to the Clerk of Courts, so it is important to obtain the Court records. If it was recent and you were represented by an attorney who failed to inform you of this, you may be able to make a Post Conviction Relief Act motion to set aside the guilty plea (assuming you pled guilty, as few go to trial in such charges) on the basis if ineffective assistance of counsel.     There is only one way, you have to take a legal advice. Post Conviction Relief Act is the thing which will be one of those things you may come across.
