    Default Selling rifle while out of state.

    I am a resident of Texas, but I have been working in Philadelphia for the past few months. I came across a guitar amp that I wanted on Craigslist and I would like to trade my rifle for it. Can I legally do this since I'm not a resident? Would I have to do the deal through a gun store? Also, he lives in NJ and the rifle is an ar-15 if any of that makes a difference

    I am not a lawyer, but I think that since the gun was "registered" to you in Texas, it would qualify as a sale across state lines, so it would have to go through an FFL.

    I can't give advise on the transfer, I am not well versed in intrerstate transfers.

    The only advise I can give is to be extra carefull. If someone here tells you they know how to do it make sure they give you a link to the actual laws and then make sure you can understand them.

    Many people give poor advise with good intentions. Also there are many good people with criminal records because they broke a law unintentionaly.
    Some people just plain suck.

    Doesn't matter if it's "registered" or not. A Texas resident owns it, and wants to transfer it to a New Jersey resident, thus, federal law requires that it go through an FFL (in ANY state).

    If I were doing it, I'd either do the transfer at a Pennsylvania FFL or ship it to a New Jersey FFL. There's no way I'd take the firearm into Jersey myself.

    If I find an FFL that will accept the transfer, we can meet there and do the swap. He gives me amp, I give FFL the gun, FFL gives gun to him (after fees). That's about the way I thought it would go down. I'll talk to the guys at the gun shop about it. Thanks for all the quick replies.

    Amen to this. The "New Jersey resident" part really opens a can of worms -- or maybe snakes. NJ has some of the most repressive firearms laws in the country. The buyer of a long gun will need a NJ Firearms Purchaser ID Card, and the gun must be legal there, which your AR-15 may not be. NJ has an assault weapons ban that is more restrictive than the expired federal ban -- more detailed info at the NJSP site at http://www.njsp.org/info/pdf/firearm...tle13-ch54.pdf. And the maximum magazine capacity there is 15 rounds.

    Pard, I don't think you are understanding what the Moderator told you. DO NOT UNDER ANY CIRCUMSTANCES GO INTO NEW JERSEY WITH ANY FIREARM, ESPECIALLY AN AR-15.

    Of course, I do enjoy reading articles in the news about great people, awesome gun owner's, best of the best of people, getting thrown in PRISON for years while traveling in NJ with guns. I don't feel pitty, I don't feel sorry. I just say

    I was going to try and transfer it somewhere here in Philadelphia. I knew that the laws were more strict in NJ, i'm not too keen on the specifics though. All in all this sounds like a big headache. I will probably just keep the gun and pony up the dough for the amp. Thanks for all the info everyone.
