    Default C&R Handgun transfer question

I am thinking about putting up a "for trade" ad in the classified sections for a C&R handgun.

    I have a C&R license.

I am only willing to trade with someone in PA.

My question is if the person I am trading with also has a valid C&R license, can I just give it to him as part of the trade transaction and we each make the required adjustments to our bound books, or does it have to be transferred through an 01 FFL?

I've looked through my C&R FFL documentation and I can't seem to find anything about this. I found 1 post on this forum that says I can transfer straight to C&R holder and I found a post on another forum that says I have to use an 01 FFL.

Here is the post from this forum:
    http://forum.pafoa.org/general-2/158...-question.html

He actually quotes part of the law that makes him believe it can be done this way. The poster in the other forum gave no reason why he thinks it can't be done this way.

As far as I know, you can just give it to them as long as he has a cr license. Just dont forget to update your book and get a copy of his license..
I have bought quite a few c/r items, shipped to my door.

I've had several C&R items shipped to my door also, 2 of them being C&R handguns. However, they came from out of state.

I guess since I didn't need to use an 01 FFL to receive those C&R handguns, I wouldn't need to use one to transfer to another C&R holder intrastate. That makes sense, but I just want to make sure I don't do anything illegal.

Obviously if the person I trade to doesn't have a C&R, then it definitely needs to go to a 01 FFL.

You have a C&R, person buying/trading has C&R, it goes to the bound book.
You have a C&R, person buying/trading has nothing, it goes through an FFL. Then it goes in their bound book and yours, and then gets transferred to them, for a price...
