    Default Selling a C&R pistol as a regular FFL transfer?

    hey guys,I have a pistol i bought as a C&R purchase (i am an 03 C&R holder) i want to sell it at a loss (no profit) i just need to move some stuff,can it be sold like a regular pistol at am 01 FFL? just never sold a C&R pistol! any input would be great.

    You can sell it directly to another 01 or 03 license holder or to a non-licensed person who goes through PICS at an 01. After you sell it don't forget to record the disposition in your bound book. That's about it.

    if I get my c&r and sell a rifle i buy for say $200 for $220 because I find a better specimen is that ok? Also I am a delaware resident and we are not required to use an ffl for private sales. as a C&R would I have to use an ffl or sell to a type 3 ffl.

    I have already heard about the C&R not being a loophole and that is not what i am looking for. I am just wanding if i sell a couple guns a year that I dont want if there would be an issue

    If you sell a weapon , a few times a year , to upgrade your collection , theres no problem with that . You are just not permitted to be actively in the business of selling firearms

    I asked a similar question on another forum. Basically you can sell to upgrade your collection as you see fit and making or losing money on a deal doesn't matter. However, if you buy an item with the intention of reselling it, that is a problem as that can be seen as engaging in business. Also, a high number of acquisitions & dispositions - especially to unlicensed people - will be a red flag to the ATF and might trigger an inspection.

    And I dont have to use an ffl of any sort unless it is required by state law correct?

    Pa requires it for handguns, Delaware lets you sell anything private and I could make a few bucks as I never sell nthing at a loss.
