HB 2224 - There goes your privacy with your doctor
New bill intro'd today - HB 2224. Gives the State Police judicial authorization to see your medical records in a firearms investigation.
Not to mention that it appears to exempt the information from the infamous "non-existent database" that the State Police don't keep...
This WAS the "land of the free" at one time, wasn't it?

AN ACT
1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2 Consolidated Statutes, further providing for Pennsylvania
3 State Police.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 6111.1(k) of Title 18 of the Pennsylvania
7 Consolidated Statutes is amended and the section is amended by
8 adding a subsection to read:
9 § 6111.1. Pennsylvania State Police.

11 (j.4) Illegal transfers.--The Pennsylvania State Police, in
12 order to investigate and initiate proceedings for any firearm
13 offense, shall be authorized to compile, analyze and use
14 information from all of the following sources:
15 (1) An application/record of sale or information
16 retained from an application/record of sale sent to the
17 Pennsylvania State Police pursuant to section 6111(b)(1).

1 (2) (i) An application/record of sale or information
2 retained from an application/record of sale sent to the
3 Pennsylvania State Police pursuant to section
4 6111(b)(1.1)(i).
5 (ii) Nothing in this paragraph shall be construed to
6 authorize the retention of information in violation of
7 section 6111(b)(1.1)(v).
8 (3) (i) A report of multiple sales or dispositions
9 received pursuant to 18 U.S.C. § 923(g)(3) (relating to
10 licensing).
11 (ii) Nothing in this paragraph shall be construed to
12 authorize the retention of information in violation of 18
13 U.S.C. § 923(g)(3)(B).
14 (k) Definitions.--As used in this section, the following
15 words and phrases shall have the meanings given to them in this
16 subsection:
17 "Firearm." The term shall have the same meaning as in
18 section 6111.2 (relating to firearm sales surcharge).
19 "Firearm offense." An offense under any of the following
20 provisions of this title:
21 (1) Chapter 39 (relating to theft and related offenses)
22 if the property stolen is a firearm.
23 (2) Section 6105 (relating to persons not to possess,
24 use, manufacture, control, sell or transfer firearms).
25 (3) Section 6111.
26 "Physician." Any licensed psychiatrist or clinical
27 psychologist as defined in the act of July 9, 1976 (P.L.817,
28 No.143), known as the Mental Health Procedures Act. 29 Section 2. This act shall take effect in 60 days.

18 U.S.C. 923, Sect 923 (g)(3)(b):
(B) Except in the case of forms and contents thereof regarding a
purchaser who is prohibited by subsection (g) or (n) of section 922
of this title from receipt of a firearm, the department of State
police or State law enforcement agency or local law enforcement
agency of the local jurisdiction shall not disclose any such form
or the contents thereof to any person or entity, and shall destroy
each such form and any record of the contents thereof no more than
20 days from the date such form is received. No later than the date
that is 6 months after the effective date of this subparagraph, and
at the end of each 6-month period thereafter, the department of
State police or State law enforcement agency or local law
enforcement agency of the local jurisdiction shall certify to the
Attorney General of the United States that no disclosure contrary
to this subparagraph has been made and that all forms and any
record of the contents thereof have been destroyed as provided in
this subparagraph.

OK, so if the State Police are now authorized to keep the "database", contrary to Federal and State laws, what the hell are the bill signers thinking? End run?

A mixed breed of Democrats and Republicans. Just goes to show that you really can not tell the difference between any of them anymore. Caltagirone is also the Chairman of the Judiciary Committee.
