    Default Copy of Stamp and form???

    Hello, I got my stamp back finally after 5 long months. Anyone know if I need to have my stamp, form with the gun when traveling with it to and from the range?

    Make several copies of the stamp side of the form. Put the original into safe keeping. Always keep a copy with the firearm.

    That form, or the copy thereof, is proof that you legally possess the NFA device.

    A copy is good enough proof for just about anyone, so I highly suggest making a bunch of copies and locking away the original somewhere safe.

    I personally have made a bunch of double-sided copies of my suppressor paperwork and keep them anywhere the suppressor might be. I have the original and a copy in a safe, a copy in the suppressor box, and a copy in every gun case I own. This way no matter what case I put the suppressor in there is paperwork with it.

    That being said, I have never been asked for it by anyone the times I have taken it to the range. I think I read on here of a few people who have had people give them a hard time over their "illegal guns/suppressors" and demanded to see paperwork. But unless it's a cop or range officer, I don't see any reason to show it to anyone.

    ATF forms are 'tax documents' so you aren't required to supply them to anyone unless it's essential and they are approved for such things. I wouldn't show them to a non-LEO, attorney, etc.

    It is a good idea to keep a copy handy in case someone important just needs to see a copy. I like making copies and rolling them up to stick inside a pistol grip or stock. For silencers and other small things I keep some copies in a plastic pouch.

    If anyone official has a problem, they can always can the NFA Branch and check the registry.

    If Form 4's are 'Tax Documents' can they be claimed at the end of the year as taxable income?

    No.

    It is a tax you paid. And it isn't deductible for individuals.

    Remember that most NFA items are technically illegal in PA, with the DEFENSE of an NFA item that is registered with the ATF:

    § 908. Prohibited offensive weapons.
    (a) Offense defined.--A person commits a misdemeanor of the
    first degree if, except as authorized by law, he makes repairs,
    sells, or otherwise deals in, uses, or possesses any offensive
    weapon.
    (b) Exceptions.--
    (1) It is a defense under this section for the defendant
    to prove by a preponderance of evidence that he possessed or
    dealt with the weapon solely as a curio or in a dramatic
    performance, or that, with the exception of a bomb, grenade
    or incendiary device, he complied with the National Firearms
    Act (26 U.S.C. § 5801 et seq.), or that he possessed it
    briefly in consequence of having found it or taken it from an
    aggressor, or under circumstances similarly negativing any
    intent or likelihood that the weapon would be used
    unlawfully.
    (c) Definitions.--As used in this section, the following
    words and phrases shall have the meanings given to them in this
    subsection:
    "Firearm." Any weapon which is designed to or may readily be
    converted to expel any projectile by the action of an explosive
    or the frame or receiver of any such weapon.
    "Offensive weapons." Any bomb, grenade, machine gun, sawed-
    off shotgun with a barrel less than 18 inches, firearm specially
    made or specially adapted for concealment or silent discharge,
    any blackjack, sandbag, metal knuckles, dagger, knife, razor or
    cutting instrument, the blade of which is exposed in an
    automatic way by switch, push-button, spring mechanism, or
    otherwise, any stun gun, stun baton, taser or other electronic
    or electric weapon or other implement for the infliction of
    serious bodily injury which serves no common lawful purpose.
    Because of that, the burden of proof is on YOU to prove that the firearm is NFA-registered. Without proof you could be arrested and have to fight it out in court.

    I'm not sure about that. Pretty much all taxes and fees (licenses, etc.) are deductible, but many can only be considered in aggregate categories. For instance, I could deduct PA sales tax but my mortgage interest is higher than what I pay in total sales tax and I can't claim both - one or the other. That being said, every year my accountant tells me that the tax stamps can't be deducted, but I've always assumed it was for those reasons.

    I don't know the answer for certain, just throwing it out there for consideration. I will pin him down on it this year.
