    Default to and from work

    ok.. I just bought a beretta px4... I have permission from the owners of my place of business to carry while at work being is I am the manager and I work with money.. I am applying for my ccw in the next week.. but untill i get it, I prefer not to leave the gun at work since their is no safe place to keep it except on me.. being is the gun came with two clips.. I figured i would leave one at work and one at home.. so transporting the gun, I would not have ammo with me.. am I in my legal rights to transport to and from work with no ammo? The law kind of confuses me.. also... I am legal to carry loaded on the streets as long as the gun is in full view and im not in, or on a vehicle? being is I have to walk outside to look at customers cars.

    I'm no lawyer but i have read the firearms laws for PA multiple times, when transporting a fire arm you need to have a license to have it in the vehicle unless you are going target shooting and then the ammo has to be in a separate compartment from the fire arm and you better have targets and range gear otherwise the officers tend to not believe you, the only other exception states you can carry if your part of corrections or law enforcement in someway. To be honest with you your better off leaving the fire arm at home until you receive your license. Also there is a great post on the Carry concealed board that goes through all of the PA laws in lamens terms, it answers your questions about open carry.

    18 Pa.C.S. § 6106

    The post above is slightly incorrect, there are more than just a few exceptions and not every exception requires the firearm to be unloaded.

    Once you get your LTCF you'll avoid most of PA's legal headaches regarding carrying, but without one it's a complicated and annoying mess where a single innocent mistake can land you in jail.

    I'm no lawyer, but I can't answer either of your questions with a yes.

    First off. WELCOME to the PAFOA. Just a clarification on some of your wording in your post. PA does not have a CCW, it's a Liscense to Carry Firearms, LTFC, and you do not have to conceal your firearm when you possess on, like some other states.

    2nd, its a magazine, not a clip.

    From 18 Pa.C.S. § 6106: Firearms not to be carried without a license

    (8) Any person while carrying a firearm which is not loaded and is in a secure wrapper from the place of purchase to his home or place of business, or to a place of repair, sale or appraisal or back to his home or place of business, or in moving from one place of abode or business to another or from his home to a vacation or recreational home or dwelling or back, or to recover stolen property under section 6111.1(b)(4) (relating to Pennsylvania State Police), or to a place of instruction intended to teach the safe handling, use or maintenance of firearms or back or to a location to which the person has been directed to relinquish firearms under 23 Pa.C.S. § 6108 (relating to relief) or back upon return of the relinquished firearm or to a licensed dealer's place of business for relinquishment pursuant to 23 Pa.C.S § 6108.2 (relating to relinquishment for consignment sale, lawful transfer or safekeeping) or back upon return of the relinquished firearm or to a location for safekeeping pursuant to 23 Pa.C.S. § 6108.3 (relating to relinquishment to third party for safekeeping) or back upon return of the relinquished firearm.

    So as long as it's in a "secure wrapper", not loaded and not within reach you should be ok.

    I think there's another problem here. You're allowed to transport unloaded to/from and to carry within your place of business without a license, but it doesn't sound like this is your place of business since you had to ask the owner for permission.

    Common mistake that trips up people in Jersey all the time as well. What they mean by " your place of business " also applies to were you work, they dont literally mean it only applies if you are the owner.

    yes, I know that "your place of business" refers to where you are employed if you are not the owner.. ive seen many shows where the say gas station attendant would shoot a robber... they would always follow it with.. my boss told me to always hand over the cash if we were robbed.. So I know I can carry at work. Anyway, Everyone has there terms for different things.. I call it a clip. I was raised on it being called a clip.. I know plenty of people that call it a magazine as well.. but I used to do tattoos a while ago.. some of the guys would call a tattoo machine a tattoo machine and others would call it a tattoo gun.. like OC and CC, its a preference I guess. I really need to find out if we are in a SOE... not that im worried too much about it since we wash all the cop cars for the town that im employed in and I know all the leos that work for the town.. I guess I want to know in case some nosy person wants to play town watch and call in a man with a gun in the open. cover my ass... Thanks for posting the law and highlighting that area.. answered my question.. at some point I will learn how to quote like you guys do. Still new here.. Im learning a lot tho. you guys are awesome!

    also... I am trying to break the habit of calling a LTCF a CCW.. I have not had one in over 10 years... 10 years ago, people were calling it a licence to carry concealed weapons since you did not need the licence to open carry as long as you could legally own your weapon.. you just needed a licence to conceal it.. Im working on it tho. Thanks again for your help!!!!
