    Default Pistol Grip Shot Gun - OC or NO Go

    Just food for thought. I'd love to have a SERBU and a sweet holster. Kinda makes a statement you are not to be trifles with . . .

    So I realize it would attract attention, but anyone have an opinion on the legality?

    Without a LTCF you can open carry except for in Philadelphia, during a state of emergency, in a vehicle, or within 1000 feet of a school. Do you have a PA LTCF or a MD permit?

    I'm not sure the legalities of open carrying an AOW. Though probably not recommended.

    In PA, it would be considered a "firearm" under this definition:

    Any pistol or revolver with a barrel length less than 15 inches, any shotgun with a barrel length less than 18 inches or any rifle with a barrel length less than 16 inches, or any pistol, revolver, rifle or shotgun with an overall length of less than 26 inches. The barrel length of a firearm shall be determined by measuring from the muzzle of the barrel to the face of the closed action, bolt or cylinder, whichever is applicable.
    But it also could be considered a prohibited offensive weapon, based on this definition:

    "Offensive weapons." Any bomb, grenade, machine gun, sawed-
    off shotgun with a barrel less than 18 inches
    , firearm specially
    made or specially adapted for concealment or silent discharge,
    any blackjack, sandbag, metal knuckles, dagger, knife, razor or
    cutting instrument, the blade of which is exposed in an
    automatic way by switch, push-button, spring mechanism, or
    otherwise, any stun gun, stun baton, taser or other electronic
    or electric weapon or other implement for the infliction of
    serious bodily injury which serves no common lawful purpose.
    For the above statute, there is a defense for NFA-registered SBS's:

    (1) It is a defense under this section for the defendant
    to prove by a preponderance of evidence that he possessed or
    dealt with the weapon solely as a curio or in a dramatic
    performance, or that, with the exception of a bomb, grenade
    or incendiary device, he complied with the National Firearms
    Act
    (26 U.S.C. § 5801 et seq.), or that he possessed it
    briefly in consequence of having found it or taken it from an
    aggressor, or under circumstances similarly negativing any
    intent or likelihood that the weapon would be used
    unlawfully.

    If it's an SBS I completely agree. But AFAIK Serbu's are all AOWs and like I said, I'm not sure how that works as far as PA Law and carrying.

    I think it would be up to interpretation as to whether it is considered a "shotgun" or not, and I doubt that has been tested in PA courts yet. Either way, I can't find a law prohibiting it, other than the offensive weapon statute.

    With the offensive weapon statute aside, there is nothing that should prohibit open carry of an AOW other than the normal requirements of a LTCF for transport in a vehicle, in Philly, during a state of emergency, or within 1000' of a school.

    With a LTCF, I don't see any law anywhere that would be a problem, other than possibly the offensive weapons law which has a defense for NFA-registered firearms anyway.

    Thanks for the info. As for as not being recommended neither is OC in PAa as far as I can tell.

    Seems like the police department doesn't really like it much at all. Even a pisrol!

    Just curious and my curiosity has been satisfied.

    I've done it every day for the past few years and never had an issue. Ran into dozens of cops all over the state that have noticed and none have ever said a word to me. This is the typical experience of my friends as well.
