    Default Can I legally possess this firearm?

    Hi all,

    I have a question for you gun law experts. My friend is a West Virginia resident who purchased and owns a pistol in West Virginia. Can he give this pistol to me (w/o any paperwork or transfer) and can I legally bring it to Pennsylvania? I am a registered hunter and over 21 years of age. I do not have my LTCF, however. This is mostly a hypothetical question. I was just wondering if any of these actions would be illegal. Thank you for any and all responses!

    the answer is "NO" he can not legally give you the pistol without first transferring it through a PA FFL.

    With interstate transfers of handguns, the handgun must be transferred through a FFL in the buyer's home state. It is federal law, a felony, which fines in the thousands of dollars and if I remember correctly a prison sentence of up to 8 or 10 years can be applied.

    How is asking a question trolling?

    To the OP,

    If you were also a WV resident he could give/sell you the gun without any paperwork so long as he believed you not to be a prohibited person.

    I have a similar question.

    My grandfather who lives in NC wants to give me one of his handguns. I know he can take it to a FFL in NC and they can ship it to a FFL here and I can receive it.

    Now my grandparents usually visit at least once a year. Can he bring it up to PA and then have it transferred or does it have to be transferred in each state and shipped FFL to FFL?

    He could meet you at a PA FFL and transfer it via the FFL to you, because you (the recipient) are a PA resident.

    Thanks. That is what I though. I'm in no hurry so ill wait for them to come up and save the double transfer and shipping charges.

    He could ship it directly to a PA FFL as long as the PA FFL accepts guns from private citizens.
    Ask your local dealer.
    He does not need a FFL on his end unless his state laws say he does.

    If he brings it to PA when he visits, make sure he is aware of the asinine laws in regards to transporting firearms through certain states.
    Going through Jersey is one such place that can run him into trouble.

    I'd have him ship it.

    Edit:
    I see you're in Allegheny co., so the Jersey does not apply most likely.
