Wait until they do this for the rest of perscription drugs.

Dr. writes a perscription for a drug that may "inhibit your ability to safely operate machinery" and all of a sudden there's a knock at the door.

IANAL but it is my understanding that the rules governing the sale of handguns are controlled by the federal gov't. Dealers are federally licensed, not state licensed. ATF, like every other federal agency, is enforcing the laws that are on the books. Possession of marijuana is still a federal crime and the regs are very specific about it disqualifying a person from purchasing firearms.

I think if you have a problem with this the solution should be to change the laws, not bitch about those charged with enforcing the laws.

With that said, this does bring up some interesting issues.

If privacy laws and the relationship between Dr. and individual is sacred, and you were to answer no on the form, how would they prove otherwise? Technically there should not be any way of cross-referencing your name = medical marijuana. Just as there should not be a way of knowing if you were on any other specific meds.

The IRS has rules regarding the definition of marriage and family and even if a state says same sex marriage is recognized by that state it does not mean the tax return can be filed as 'joint'. As of now the married couple still files individual returns. The IRS just enforcing the laws as written.

I am not a fan of selective enforcement of any law. Whether it is illegal immigration, the mayor's son speeding, or this. There is always a lag between social change, whatever it is, and the law.

Eliminate the ATF and the DEA.

    Many problems solved.

I got him too! Well deserved.
Also, do not forget that the A and T in ATF stand for two of the most widely used and abused drugs known to man...but of course the gov makes money by taxing them so it's ok....right?

    a. How is said dealer supposed to know if a person has a MMC? Are they supposed to start asking buyers?

If so they are breaking FEDERAL privacy laws

    b. Is ATF now going to ignore the HIPPA laws and start cross referencing people with cards to gun onwers?

    Again, violation of federal law

So they are pushing an agenda that either forces FFLs to break federal law or they themselves are planning on breaking federal law ... either way this is going to end up in court

Once again, the states need to grow a set and tell ATF to blow it out their asses as several states have done on the issue of guns made and used within the confines of the state.

Until the states start exercising the rights given them under the constitution these federal agencies will continue to push the envelope.

The OJunta cares not a rats ass about laws.
    They only care about dictates.

    Beat me to it.

Wait until people receiving psychiatric care or meds for depression (Zoloft and such) = prohibited. It's around the corner. They just keep putting the feelers out seeing how much America will tolerate.
