    Default I am just amazed by this article on Handgunlaw.us

    In 2006 a PA constable is serving a warrant in NYC. As the PA Constable is in NYC waiting to pickup a friend before serving the warrant the NYPD shows up and blocks his car. The PA Constable shows the NYPD his badge and ID. No matter what id the PA Constable produced the NYPD claimed it was fake. The PA Constable then shows the NYPD all of the warrants he was executing from his car and the NYPD claim they were fake too. Then the NYPD asks the PA Constable if he has a weapon and then that's when he was arrested. The NYPD still thought he was a phony.

    Really, Seriously, wtf? The PA Constable has a badge; ID; warrants signed by PA; and a gun; and the NYPD still did not believe that MAYBE he was a LEO? Are the police that blind and stupid? At what point does all of the pieces start making a picture. I'm like in disbelief after reading this article.

    Please. It is not about stupidity. It is about power.

    It is all about the power, and who has it. By executing a warrant on their turf, he was disrespecting their power. Which they promptly corrected. And no badge, paper, or ID was going to stop them. In fact, nothing was going to stop them.

    With politicians and police it is always about power and control. It is a mistake to look at it any other way. Once you start seeing this, much that has been confusing will become clear.

    The ironic thing is WE are supposed to believe them whenever they say "I'm a cop!" They could be plain clothed with a gun in your face but we gotta take their word for it

    Manuel Rodriguez a/k/a Arthur Rodriguez (New York). He is a Pennsylvania Constable. Under Pennsylvania law he is authorized to carry a pistol without the need for a Pennsylvania license to carry a pistol. He was in New York City to execute a Pennsylvania warrant for an offense. He was parked in a Ford Crown Victoria equipped with police lights and it looked like an unmarked police car. New York City police questioned him about his identification and his occupation. They ignored his status as a police officer and ignored that he was executing a warrant. He was arrested for criminal possession of a pistol in the third degree, a felony. On November 3, 2006, Justice Ronald A. Zweibel of the New York Supreme Court, County of New York, held that Constable Rodriguez is a peace officer under Pennsylvania law and he is also a peace officer under New York Penal Law 265.20, which exempts out of state peace officers from needing a New York pistol license while performing their official duties in New York. Justice Zweibel further held that the Law Enforcement Officers Safety Act of 2004, 18 U.S. Code 926B, applied to him. Accordingly, the court granted the defense motion to dismiss the indictment. The court also ordered Constable Rodriguez's property, including his pistol, to be returned forthwith.

    Interesting in light of NYC sending NYPD detectives to other states to do gun stings.

    You are overlooking the salient fact that this took place in NYC.

    One of the only cities worse than Philadelphia with regard to gun rights. The attitude of the NYPD is that they will arrest anyone they find with a gun, and let the lawyers and the courts figure out if he's legal.

    What I find amazing is that according to the court documents they only stoped because they thought he was LEO and wanted to see if they could assist.
    When they found he was LEO they instead arrested him!
    Idiots.

    The other problem is being ignored here...
    The DA pressed charges!
    They should have been perfectly capable of reading the law and saving the taxpayers a few dollars by not forcing this to a judge.
    DAs are as big of a problem as cops.
    Cops make bad arrests, then ambitious DAs prosecute even though it is a bad arrest.
    Something needs to be done about these people.

    Good on the judge for actually reading the law and dismissing the case based on its lack of merit..

    Funny, thats EXACTLY how NJ handles it !! Further proof of my long held contention that the NJ Legislature is FAR to unduly influenced by their NYC Counterparts

    the problem was that the guy was a constable and they didnt view him as a police officer. if he had been a real cop they would have taken him out for a beer.
