    Default Question on Long gun transport and carry

    I'm pretty confident of the answer here but wanted to be sure.

    I know transport of a long gun, say a shotgun or rifle, AR15 is legal if it is unloaded. No license is needed to transport them unless in Phila. But still, with a LTCF it would be legal.

    I also know that carrying the above either open or concealed, loaded outside of a vehicle is legal, even without a LTCF ( outside of Phila).

    Would it be legal to drive somewhere with a long gun unloaded, arrive, load up and walk around.
    Would it be legal to do the same in Philly?

    Is what I believe to be true, true? TIA

    Thanks. Don't intend to do it, especially in Philly without getting shot. Just curious.

    If a LTCF firearms applies to firearms, not long guns, can someone point me to where a LTCF is needed (rather the exception) that it is needed for long guns in Phila?

    I thought to conceal it had to be either the lawful definition of a handgun, SBR, SBS, or AOW?

    §6108. Carrying Firearms on Public Streets or Public Property in Philadelphia.

    No person shall carry a firearm, rifle or shotgun at any time upon the public streets or upon any public property in a city of the first class unless:

    (1) such person is licensed to carry a firearm; or

    (2) such person is exempt from licensing under section 6106(b) of this title (relating to firearms not to be carried without a license)

    The items you mention do require a license to conceal. 'Traditional long guns' do not, most likely because it's particularly difficult to do so effectively.

    "Firearms" require a license to conceal. Traditional long guns are not "firearms" as defined by the licensing statute, thus it is legal to conceal them, because their is no other statute that prohibits such an act. It's the same as concealing a broom handle, tennis racket, etc.

    The statewide prohibition is carrying "firearms" concealed or in a vehicle in 6106(a). Carrying loaded weapons other than "firearms" in a vehicle under is prohibited 6106.1. Therefor a person can carry a unloaded long gun in a vehicle, or loaded/unloaded rifle or shotgun openly or concealed on foot without a license.

    However under 6108, you need a LTCF to carry firearms, rifles, or shotguns on the streets of a City of the First Class. And under 6107 you need a LTCF to carry a firearm defined as "any weapon that is designed to or may readily be converted to expel any projectile by the action of an explosive or the frame or receiver of any weapon" during a declared state of emergency.

    It's also worth keeping this statute in mind. Depending on the time and place, this could be low or high risk.
    § 2301. Prima facie evidence of hunting.
    (a) General rule.--For the purpose of this title, any one of
    the following acts shall constitute prima facie evidence of
    hunting:
    (1) Possession of any firearm, bow and arrow, raptor,
    trap or other device of any description usable for the
    purpose of hunting or taking game or wildlife.
    (2) Possession of the carcass or any part or parts of
    any game or wildlife.
    (3) Pursuing game or wildlife in any manner prohibited
    by this title or commission regulation.
