    Default Serial number of a firearm

    If the police check your firearms serial number and it comes back no record found are they allowed to keep it?

    The firearm is question was bought new on 3/2/11.

    If its not reported stolen, lost OR the person isnt threatening anyone or himself with the gun, I dont see how they can legally keep it.

    Of course, there's a difference between what the police are supposed to do and what they will do.

    No. PA has a sales database, no registry. To the best of my knowlwdge with the info you've provided, they would have no legal reason to do so.

    Police have an affirmative duty to determine the lawful owner and return it to that owner, unless there's a crime involved or the owner is a prohibited person.

    If they seize it from you, and they have no other competing claimant, then they should give it back to you. Your possession creates a rebuttable presumption of ownership.

    If you have to take them to court, the UFA authorizes the court to make the police pay your attorney fees and costs. If you go in with the receipt, you should win.

    The receipt for the purchase of the firearms and the State police paper work was offered and they did not care about it.

    No offense to your friends, but that was a downright stupid decision.
    I would have them call IMMEDIATELY and request paperwork on the incident.
    Matter o fact, go to the PSP barracks in person and demand to speak to someone.

    Hell, if its the PSP near you, then its on Rt. 119 across from where they fix those tanks and behind Penn State campus.

    It was the Redstone Township Police dept. An when called and asked to return they never did. As far as the State Police they was called and could care less.

    This happened to a friend of mine last night. It was not my Firearm that was taken.

    There's something more to this...Did somebody get mouthy? Piss off the cop? Something happened. I can understand that the gun was not in the database yet, so it couldn't show up in a search of the database. I'm sure it takes more than a month to show (although it shouldn't take that long). But showing the receipt and form should have cleared everything up right away.

    I would consider reporting it stolen, as it's no longer in my control.

    what if you have no receipt? i havent bought a gun in decades and most of my records were lost to a basement that flooded with raw sewage.
