    Question Question: Are you forced to CC by law when you are issued a LTCF?

    I had an argument with an ex-LEO about this today. I was hoping to print out the statutes for him, but I can find them.

    He says that your right to OC only asks to be hassled, and when you are issued a LTCF you no longer can OC, only CC.

    I said OC is perfectly legal with or without a LTCF unless you are in Philly.

    We had a bit of a tiff about it, and I stopped it by saying I would get evidence. I used the forum search but the results are too many to go through. Please help!

    He's wrong. Have him find anywhere on the LTCF that says "concealed".

    You will learn that cops, especially ex cops don't know the law.... Call Philly division, they issue permits and ask them. The phone number is 215-685-3663... be safe. Do not rely on cops.

    Licencing allows the activities, it does not specifically exclude any other legal activity.

    Since open carry is legal (some restrictions do apply) the fact that you have a license allows you more flexibility in carrying your firearme, as you deem fit.

    A similar example is a drivers license (dont start on a right vs privilidge!)... since I have a license to drive, does that mean I HAVE to drive everywhere... cant take my bike, walk, bus...etc. Of course not. It allows me to drive when I find it convenient for me to drive, or to take my bicicle, walk, etc.

    Question #3- What can police legally do when they observe a person engaging in
    open carry?
    Answer #3- In most cases, the police cannot engage the person in anything other
    than a mere encounter. Unless the person engaged in lawful open carry is in
    violation of a specific State or Federal firearm prohibition or is carrying in a
    restricted area (For example: prohibitions contained in §6105, possession by a
    minor §6110.1, possession on school property §912, possession in a court
    facility §913, carrying in Philadelphia §6108, carrying in a vehicle, carrying
    during a declared state of emergency §6107), the officer would not have specific
    reasonable suspicion of criminal activity merely based on observing a person
    engaged in open carry. Therefore, a stop and frisk or any other seizure would
    not be legally justified.
