Firearms Restoration
Hi Everyone,
I am new to these forums and was hoping someone might be able to enlighten me on any new legislation/procedures toward firearms restoration. Twenty Five years ago I bought alcohol for minors and plead guilty to a Misdemeanor 1 here in PA. I was sentenced to 6 month probation and paid a fine. I have no other convictions and am now 46 yrs old. A few years back an attorney I met with said I would need a Gubernatorial Pardon to regain my right to own a firearm. I've heard there may be new legislation that might make it a bit less daunting of a task? Any advice would be greatly appreciated.
Thanks So Much,
Bob,
Hershey, PA

Re: Firearms Restoration
Own or Carry? I thought in most cases only a Felon was barred from owning firearms. Buying alcohol for someone is not a violent crime and I hardly think should be a crime at all... Especially if its an 18 or 19 year old person buying a few beers for his 17 year old buddies... no more then it should be a crime of an 18 or 19 year old man to have sex with his 17 year old girlfriend. My googling does not show that a Misdemeanor 1 automatically prevents someone from owning firearms in PA.

Re: Firearms Restoration
Any Misdemeanor 1 would prohibit owning a firearms as well as a license to carry firearms.

Re: Firearms Restoration
Thanks for the replies folks. I was hoping someone could provide an interpretation of HB 264, and if it even passed?

Re: Firearms Restoration
Is this what you are talking about. This is HB 264. A very short bill.
Amending Title 18 (Crimes and Offenses) of the Pennsylvania
Consolidated Statutes, further providing for the offense of
aggravated assault.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 2702(c)(2) of Title 18 of the
Pennsylvania Consolidated Statutes is amended to read:
§ 2702. Aggravated assault.
* * *
(c) Officers, employees, etc., enumerated.--The officers,
agents, employees and other persons referred to in subsection
(a) shall be as follows:
* * *
(2) Firefighter, including volunteer firefighters and
special fire police.

Re: Firearms Restoration
Currently, assuming you didn't get ARD for the disposition, your only option is a pardon.
