    Thumbs down Schumer Pushes for Military to Report Applicants' Drug Use to Prevent Gun Purchases

    WASHINGTON -- If someone admits to a federal official that he's used illegal drugs, that information should be sent to the FBI so that person can be disqualified from purchasing a gun, Sen. Chuck Schumer said Sunday.

    Noting that the alleged shooter in the Tucson massacre had admitted to military recruiters that he had used drugs on several occasions, Schumer said he is proposing to the Justice Department and Bureau of Alcohol, Tobacco, Firearms and Explosives that the military be required to notify federal officials about such admissions. The New York Democrat said such a process does not require new legislation.

    The left pushes marijuana as a legal thing.....yet use it as a bludgeon when it serves their advantage.

    In better times, tar and feathers would be appropriated for people like Schumer.

    Beware of unintended consequences. Requiring the military to disclose to the FBI the freely admitted use of drugs is not a solution without possible negative consequences. For one thing the military, by not disclosing information, has a better chance to get honest answers. Let people know that their information is going into a nat'l database search-able by anyone with an FFL and many drug users may chose to lie.

    Secondly, it seems rather questionable to limit a constitutionally guaranteed right without a conviction. Rather like asking someone if he has ever been arrested and if he answers yes taking ;his voting rights away. I know that it is self disclosure, but still it isn't something that has been adjudicated by a court, and a person may well have a misunderstanding about what he is admitting to (otherwise why would someone trying to join the military admit to an act that would keep him out?). Using the crime example a recruiter asks have you ever committed a crime that is punishable by 2 years in prison in any jurisdiction in the US? Who could possibly know? I know that the military has a scale of crimes that list specific acts, regardless of what they are called in the various jurisdictions. This is tied to a sliding scale and allows people with excellent skills with moderate crimes to be admitted along side candidates with moderate skills but lesser crimes.

    Interestingly a blood test that comes up positive for drugs is different in my mind, as it is a more positive proof of use than a simple question that is easily misunderstood. Yet even with this there has been no trial and proof of guilt, so I would be reluctant to limit civil rights based on this.

    Schumer is simply an anti-civil rights politician who is little concerned with the rights of the people. No doubt his efforts will get him some contributions from the few remaining die hard gun control doners.

    Question number 11e on form 4473 asks if the applicant is a habitual drug user a yes answer disqualifys the purchaser.

    Is someone suggesting that some people lie on the form? After all that would be perjury!

    What law is that? There's nothing in 18 USC 922 that prohibits simply because of past drug use, is there?

    Telling a recruiter you smoked some weed back in the day doesn't make you a "habitual" drug user...it just makes you the majority of Americans.
