    Man tells police gun fell from his belt
    November 12, 2007

    A 32-year-old Whitehall Township man lost a .40-caliber handgun Friday when it apparently fell from his belt as he rode his motorcycle, according to Allentown police.

    Alfredo R. Quiles of 1590 Alta Drive reported the gun missing about 2:30 p.m. He told police he had the weapon tucked in the small of his back when ''the gun fell out at an unknown place,'' a police report stated. Quiles also lost 14 bullets.

    Police entered the Smith and Wesson model into the National Crime Information Center database

    Joking I know members of this forum have better sense than this.

    In my opinion "the loss" off a gun in this manner is negligent and he should be held accountable if the gun is used in a violent crime. If someone breaks into you home and steals the gun, I don't feel the owner should have any liability.

    That stinks. One reason I am researching holsters before I buy.

    I know a guy who was small game hunting in the Dunbar area a few weeks ago and his .357 fell from his holster and as far as I know he still hasn't found it.

    Quiles also lost 14 bullets.
    i'm amazed the guy was apparently able to recover the casings, primers, etc. from the rounds in the gun, but not the bullets.

    In my opinion "the loss" off a gun in this manner is negligent and he should be held accountable if the gun is used in a violent crime.
    i disagree. imho, if someone finds that gun and commits a crime with it, the blame for that crime falls entirely on the person who committed it.

    if you leave your keys in your car and some drunk steals it and runs someone over, should you be held responsible for the that?

    We will agree to disagree on this one, the someone that finds and commits a crime with it is guilty of the crime, but through his negligence the owner could be considered an an accomplice (one who aids or abets another in a criminal act).

    As far as car goes, that is comparing apples to oranges, he had no idea where he lost the gun and I would be fairly sure you knew where the car was parked--if a friend stops by your house and has a few beers and you allow him get behind the wheel of his car are you liable for his actions??

    imho, no, you are not.

    i realize this puts me at odds with the prevailing legal winds in this country. but i believe strongly that i, and i alone, am responsible for what i do. i am not responsible for anything anyone else does unless i force them to do it. (the one exception to this, imho, is that parents are responsible in at least some instances for what their kids do.)

    so, yeah, we'll just have to agree to disagree.

    Gotta say that since there are no laws on how you retain your firearm, and since you can't legislate common sense, I can't agree that the blame falls on the person who loses his firearm. There are so many ways in which a firearm could find it's way "out of your possession", but to hold him responsible for someone else's actions isn't acceptable.

    Using the same logic, if his "found" firearm were used to stop a crime... let's say a school shooting... would his loss of his firearm, not make him a hero?
    I don't think so.



    That said, I think it's retarded to carry a handgun in that manner.
    At the same time, there are no laws against being a tard.
