    Default Lansdowne Borough preemption violation

    I figure it's time to put it up here.....

    photo of the sign with a preemption violation (yes, I know part of firearms is covered, but there's another sign on the other side of the park that clearly reads firearms):


    I don't have a copy of their park rules handy anymore, but I did write the ordinance in my letter I sent to the solicitor.

    -Ordinance number 1067 (“Rules and Regulations Governing Lansdowne Parks”), Section 3(h) states that “Possession or discharge of any type of firearm, bows and arrows, air guns or slingshots, or fireworks”

    I spoke to the solicitor at their last general council meeting for a few minutes and he said they would discuss it at their next business meeting which was last Wednesday. their next general council meeting is September 15th @ 7:30

    I plan on attending..who else is going to come out?

    It would appear from the way the ordinance is written concerning weapons that open carry is also prohibited by Lansdowne Borough.

    Lansdowne Ordinances

    Section 326-2
    "Except when authorized in a private home by the owner of such home, it shall be unlawful for any person to use, discharge or display any air gun, air pistol, spring gun, spring pistol, BB gun, BB pistol, pellet gun, pellet pistol, C02 gun, C02 pistol, any device which impels a projectile of any kind, bow and arrow, blank gun, blank pistol, starter pistol or replica model or fake pistol or gun in the Borough of Lansdowne; provided, however, that the prohibition against display shall not apply to merchants lawfully engaged in sale of merchandise within the business premises devoted to such sales."

    At best, the phrase "starter pistol or replica model or fake pistol or gun in the Borough of Lansdowne" is poorly written. This ordinance reads as a possible prohibition on open carry.

    There is also a parks pre-emption violation in section 235-3, Prohibited acts in Borough parks:
    "H. Possession or discharge of any type of firearm, bows and arrows, air guns or slingshots or fireworks."

    interesting..thanks for noting those. I'm going to make an honest attempt to speak at the next council meeting...I'm really not a public speaker, but I just need to man up.

    it's on the corner of Baltimore Avenue and Lansdowne Avenue
