    Default Fore-warned is Fore-armed HB 2632

    Just offered in the House. As of this time text and disposition has not been posted. The author is Tina Pickett (PA -110) a Republican from Towanda. Her district covers Bradford, Sullivan and (part) Susquehanna Counties. To date she has been very good on support of gun owners and their rights. But, as with all, we'll see when the text is published.

    Any idea what she may be presenting?

    Mayhaps some teeth in the 'shall issue' to provide penalties for those counties that , uhhh, stretch the requirements in order to refuse citizens who SHOULD qualify for a license?

    Just got off the phone with Kim Stolfer. This bill Removes the word Temporary, which at the end of the year, if it had not been removed all unpaid funds go to the General Account. This makes a Perminant Fund for Licensing and a set fee at $25.00 with $5.00 going into the Firearms Licensing Modernization account for Sheriffs to keep updating their systems. only problem is those Sheriffs charging more than $25.00 need to be smacked down and have the fee brought back down to $25.00

    AN ACT

    1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania
    2 Consolidated Statutes, in firearms, further providing for

    4 The General Assembly of the Commonwealth of Pennsylvania
    5 hereby enacts as follows:
    6 Section 1. Section 6109(h)(2)(ii) and (iv) of Title 18 of
    7 the Pennsylvania Consolidated Statutes are amended to read:
    8 § 6109. Licenses.

    10 (h) Fee.--

    13 (ii) An additional [temporary] fee of $5 shall be
    14 remitted by the sheriff to the Firearms License to Carry
    15 Modernization Account, which is hereby established as a
    16 special restricted receipt account within the General
    17 Fund of the State Treasury. Moneys and investment income

    1 in the account shall be awarded as grants to sheriffs to
    2 implement the system, including grants to reimburse
    3 sheriffs for expenses incurred prior to the effective
    4 date of this paragraph.

    6 [(iv) This paragraph shall expire five years after
    7 its effective date. Any surplus funds remaining in the
    8 account established in subparagraph (ii) at such time
    9 shall lapse into the General Fund.]

    What would the recourse be? State says do it. Sheriff says no. Then what?

    the sheriff could be brought up on numerous charges. right now those sheriffs over charging people for LTCFs commit i believe and M3 offense for each person they overcharge. that adds up. ontop of that comes the private criminal complaints and so on.

    Has anyone here been overcharged and filed a criminal complaint yet to your knowledge?

    not yet, this is just being brought to light out east and FOAC is assisting in the "Smack Down" of the Sheriff.
