    Default They either don't know, or they don't care

    Conversation with the ****Co Sheriff's Department this morning, in part:

    Me: So, this thing with expiration, you're good six months beyond the expiration, right?

    Them: No, expired is expired. Once it's expired, you have no right to carry that weapon.

    Meanwhile, here I sit, looking at 18 Pa.C.S. § 6106 (b)(12):

    A person who has a lawfully issued license to carry a firearm pursuant to section 6109 (relating to licenses) and that said license expired within six months prior to the date of arrest and that the individual is otherwise eligible for renewal of the license.
    It all seems to go back to opinion. Nobody seems to want to enforce a known body of law, or at least be willing to stop for a minute and say, "Hey, let me look that up."

    It seems the biggest problem with Law Enforcement Management in this country is reading comprehension. I prescribe the following:



    Why should the management of the Law Enforcers care about the law, that is not their job. In the event that they are wrong, it is covered by the dime of the local government. There is no risk for them to be wrong.
    Join the groups protecting your rights from the fools trying to take them from you!

    They all want you to get arrested, hire an attorney, and fight for them to follow the law. That is what the attitude seems across the board, even with some of the firearms rights groups.

    No one seems to just say, "Its against the law" or "Its against the constitution, we cant". cant have that, we are always faced with a game that ends with us loosing rights, little by little.

    IMHO it would appear that the key word is "arrest" it would appear to be an exception to the law or a loop hole in favor of a LTCF holder who had been caught carrying while expired.(within 6 months) However if you are not arrested then than the licence is just expired. So do you have the right to carry with an expired LTCF. The answer would be no! However the law allows an exception if arrested for doing so within 6 months of experation. IANAL Just my 2 cents!
