    Default Rules on smithing

    I have a SA-85 that I want to put a compensator on. I have the parts and the die. My local place said they can't do it. I can take it to a machine shop that I know can do it.

    As I understand it, I cannot leave the gun there(no ffl) however I can wait while the guy does the work and leave with the weapon. Correct?

    I 100% do not want to bend or break the PA laws. Is this a problem?

    To be honest, I'm not sure if it's federal law about that; which I'm guessing that it is because it's regulations from FFL (federal level). In Texas, that is EXACTLY how it works. If they don't have an FFL, you cannot leave it there. You could however take it there wait, let him do the work, and take it him. That's how it is in Texas as well, and I'm pretty sure you are correct. I am NOT a lawyer, and hopefully someone else who KNOWS wil come along. My understanding is that you are correct.

    ianal one of our resident ffl's my have a better answer. but this is my take on the deal.
    if your sa85 is a sa85 hungarian ak47, then i would see no problem leaving it at a non ffl. my reason for this is that it is a longarm and in pa would not need an ffl to transfer or a ltcf for any reason. so leaving it at a machine shop should be legal as long as, to the best of your knowledge the person to leave it with is not a prohibited person. now if i'm wrong and your sa85 is a hand gun, then the person you give it to must hold a valid ltcf.

    SA-85 is a long gun. So that is a good point!

    I will double check with the machinist, but most likely I will wait for the work to get done. He is a sharp guy and should be able to either let me do it or knock it right out himself.

    1) Correct on the transfer. No paperwork needed for long guns in Pa.

    HOWEVER

    2) Per fed law one cn not engage in the business of repairing firearms without a FFL.

    So no, you can not leave the gun there for work unless they have an FFL. Actually, they bear the brunt of the prohibition, but now that you know you know not to be a co-conspirator
