    Ridiculous.


    Philadelphia is attempting to violate preemption by prohibiting people from using permits other than PA's when carrying in the city

    Thanks for the heads up.

    They acknowledge it's a violation of state law and still push this crap. I really wish there was a penalty for this sort of thing, beyond a challenge in court. This is ridiculous.

    The "Florida Loophole" has been talked about for awhile now. Its not that they wont accept other states' permits, they just wont accept them when held by a PA resident.

    Its BS. There are ads saying that Tom Corbitt will allow violent criminals to carry legally because he didn't support closing the Florida loophole. Its not true because criminals will be denied a Florida permit. Also Florida permits are actually harder to obtain because you have to take a class. Anyway there are a million threads on this subject so you might want to do some searching.

    Councilman Wants to Close Florida Gun Loophole

    Councilman Darrell Clarke today introduced legislation in City Council that would attempt to close the so-called “Florida gun loophole.”

    The legislation would require people carrying concealed weapons in the city to have a permit from the state of Pennsylvania.

    “It’s clearly something that is common sense and we should do at the local level,” Clarke said.

    Currently, a Pennsylvania resident can obtain a nonresident permit to carry a concealed weapon through the mail from another state, even without a permit in Pennsylvania. The loophole is unpopular with Philly cops because it allows those denied permits locally to get them elsewhere.

    Clarke acknowledged that if this become law, it would likely be challenged in court, like other local gun legislation efforts. But he said he was confident this bill could withstand a challenge.

    “We think this is more than reasonable,” Clarke said.
    Why shouldn't Philly council with no respect for the Rule Of Law NOT attempt this. Unless someone has standing they will get away with this and no one would be held accountable for their illegal actions, take them court they don't care taxpayers pick up the tab and if they still lose they face no consequences because the DA won't charge them for political reasons.

    Now In Rep Metcalfe HB 1541 would have been passed.....it would have paid to fight them to the end not matter the cost.....as they could be held personally accountable for their illegal actions (at least in cash from their pockets, not just the taxpayers)

    More than reasonable? Less than reasonable? Both unreasonable, by definition, and in practice. It always seems that they ditch logic and pander to emotions when they want to slime anything around preemption restrictions.

    Also, let's not forget the LIE CeaseFire is spreading that lost & stolen has been upheld by the court.

    So has anyone contemplated contacting councilman Clarke and asking him, since he is such a law abiding individual, how he would feel about having charges filed against him for knowingly proposing a violation of state law? Could be fun to hear his stuttering.

    DARRELL L. CLARKE is City Council’s Majority Whip and represents the Fifth Council District which includes North Central Philadelphia, Strawberry Mansion, Lower Hunting Park, Ludlow, Yorktown, West Poplar, Fairhill, Brewerytown, Francisville, Spring Garden, Fairmount, Logan Square, and parts of Northwood, Fishtown, Northern Liberties, and Center City.
    That would be great. I'm fairly certain there are members living in his district.

    Yeah, I live in his district. And vote against him every chance I get. I've contacted him before. No stammering or stuttering on his part. He just doesn't respond to constituents.

    Yeah, kind of interesting that the only reason this hasn't been struck down is "lack of standing" -- nobody's ever actually been arrested for violating this "highly effective crime-fighting" law.
