Need extra Xmas cash? Straw purchasing not recommended...
This genius thought he'd make a few bucks buying and selling 5 to 10 guns to a few upstanding citizens. Now he's facing 5 to 10...

For one thing it sounds like he sold the pistols without a transfer.

With this genius, he is lucky he didn't get the chair.
Defense attorney Taylor Dunn told Capuzzi Wednesday that his client did not appear to be knowledgeable about gun transfer laws and did not turn a profit, selling the guns for the same amount he had paid. Dunn also argued Cimabue needed money to pay his bills, which the judge indicated did not make any sense if he was not selling the firearms for a profit.

I'm not even going to bother finishing that article.
What they are calling a straw purchase isn't a straw purchase.
Sure, it's not legal to sell a handgun without a FFL transfer, but calling that sale - months later - a straw purchase is a bit of a stretch.
These articles are always chock full of half truths, implied false laws, and opinions by police that are not the same as the actual laws.

That's what i was thinking. Straw Purchase would be buying for the sole intent of selling them to a person who is not eligible to purchase on their own. Seems he bought them and later needed money so he sold them. At most its illegal sale of a handgun. Whats to say the people who bought them were prohibited.

“These guns on the street are a problem,” said Capuzzi. “Every day someone is shot … The reason they’re straw purchases is because the people that get the guns can’t get them legitimately.” It's not worded well, but one can interpret that the guns found there way to prohibited persons. If not, the kid should claim incompetent counsel and demand a retrial.
