    Default what is legal in my yard in Phily?

    are you even allowed to have a firearm outside your house without a permit?
    can I clean my rifle or pistol's on a picnic table in my yard after a day at the range?
    what about taking pictures using natural sun light outdoors on my property?
    does a person WITHOUT a LTCF have any rights while on their own property?
    or does the city own my yard and make the rules?
    does it make any difference if you HAVE a LTCF?

    18 Pa.C.S. § 6108

    No person shall carry a firearm, rifle or shotgun at any time upon the public streets or upon any public property in a city of the first class unless:
    (1) such person is licensed to carry a firearm; or
    (2) such person is exempt from licensing under section 6106 of this title (relating to firearms not to be carried without a license).

    I'm not aware of any laws that apply to private property in Philadelphia.

    The state laws still apply, so if you are concealing a firearm outside your "place of abode" you'll need a license. I think that "place of abode" only means the structure you occupy, ie your house or apartment, and not your yard.

    You need a LTCF to conceal on your property (outside your house) anywhere in PA. Yes, that means in your yard too.

    In Phila, this might also apply to Open Carry too, but I gotta re-read the statute real quick to confirm

    Edit: OC in Philly in yard should be good without a LTCF since 6108 doesn't specifically mention "abode"

    We live in uncertain legal times. We know what the law says, we know that concealed carry or vehicular transport require an LTCF, or a narrow exception. You can't conceal otherwise while riding your own tractor in your own yard, for example.

    But Philadelphia is even worse. On paper, simple possession in public requires an LTCF or an exception. Expect the cops to interpret that to mean "anywhere VISIBLE by the public". The police and city council have a pattern of violating state law, and harassing people engaging in lawful conduct. So even field-stripping your unloaded rifle on your patio on a nice day could result in adverse governmental intervention, warrantless intrusion, charges of disorderly conduct or worse.

    On paper, simply possessing a gun in your yard, unconcealed, is lawful. In reality, if a neighbor calls 911 in a panic, it could easily cost you something, in legal fees, lost times, even convictions on bogus charges.

    And as anyone who's paying attention can tell you, we can no longer rely on the Superior Court to restore sanity. They have an anti-gun rights agenda, from holding that "any person" excludes Pennsylvania residents (making us non-human?) to holding broadly that judges are not empowered to provide actual "restoration of gun rights" under the "restoration of gun rights" statute.

    I no longer pay attention to what the law says. I have a sense of the times that we live in and trust my instincts. I live in the suburbs but I will never walk outside the house even with a rifle unless somebody pays my legal fees to make a point.

    Cafe, it might be legal, it might be not. Having the LTCF covers you, legally. Does not mean you won't get hasseled.
