    The retired police captain who shot and killed the man texting his daughter while in a movie theater will use the Stand Your Ground defense, according to his attorney.

    This is a most ridiculous defense. The attorney ought to know better.

    A defense attorney will grasp anything when all other legitimate defenses fall by the wayside. First and foremost, the shooting has to be under justified conditions before "stand your ground" can be trotted out.

    Perhaps the attorney can utilize the tried and sometimes true temporary insanity plea.

    This attorney is doing the entire country harm trying to use that defense. Those already opposed to the law will make the most of it. Watching the announcement on TV, I thought it was going to be a temp insanity. I was stunned when they said stand your ground.

    That heart-breaking, poor woman and child. How can anyone watch that and not demand the law be repealed. I wish the court had a way to test the defense ability to apply the law via rules of procedure.

    You guys are jumping to a conclusion way too fast. If this guy loses, it will be a huge positive for us, as it will illustrate to the antis that SYG cannot be used to justify murder. Now if he actually WINS (which is very possible because it would help certain agendas), then we need to start worrying.

    Good reasoning and true...but for the media, which will make so much hay of the defense theory the actual outcome will be minor to the non-gunners.

    What else do you expect the defense attorney to say? He's got to come up with something and this appears to be the best available option.

    None of us were there, so let's not be so quick to think we know what happened.

    The media wants it to get attention so they share selectively to make it as sensational as possible.

    The more info that dribbles out, the more I can start to understand how it happened. Not saying it did not go too far, but nobody there was innocent.
